DA said today’s statutory rape trial not CSI

NORWICH – District Attorney Joseph A. McBride told a group of prospective jurors Monday that they would not be listening to a complex argument this week.
“This is not CSI,” the DA said. “We don’t have any DNA. We don’t have any scientific evidence or any of that which is on Thursday night at 9 p.m.” McBride called the statutory rape charges against Gary J. Button Jr. and the proof against him, “a simple case.”
Button, 40, formerly of 190 state Route 320 in Norwich, spent the first day of his trial silently at the defense table. The Norwich man faces three charges that stem from the allegation that he had sexual intercourse with a 13-year-old girl during July of 2005.
The DA asked prospective jurors if they would have a problem hearing about sexual abuse and passing judgment on an individual. Button, who is hard of hearing, watched a transcription of the opening day on a computer monitor as events unfolded.
The Norwich man’s defense attorney, Kevin Dayton of Cortland, asked the jury pool if any had ever been falsely accused of something, and he asked each if they could consider the fact that the justice system might be falsely accusing his client. He also inquired if any were fans of the popular CBS drama.
Button faces charges of rape in the second degree, endangering the welfare of a child and sexual abuse in the second degree. County Judge W. Howard Sullivan said the trial could resume and finish today. Testimony is expected to come from the alleged victim, a doctor who examined her and a law enforcement officer who took a confession from the defendant.
