Court gives young man a second chance

NORWICH – The future of Benjamin Ryan, 20, lay in the hands of the Chenango County Court Monday. “We ask that Mr. Ryan be removed from our community,” said District Attorney Joseph McBride. His defense attorney, Alan Gordon, responded to the court, “To say we’re giving up on a 20-year-old man with no criminal history is a shame.”
Ryan was arrested for 2nd degree burglary, but had no prior trouble with the law. Ryan was referred to Treatment Court, because he had an established past involving drugs and alcohol.
Ryan had been admitted to treatment court ,but had violated his probation on more than one occasion by failing to check in or not appearing for a meeting, said Gordon. “Probation is done with him, judge. They don’t want him,” said McBride. “Probation has to deal with people they don’t want to all the time. Unfortunately it’s part of their job,” said Gordon.
Gordon urged that Ryan be given a second chance, because he said his client is young and immature and did not realize the true repercussions of his probation violations. “Prison will not rehabilitate him,” said Gordon.
Drug Treatment Court Coordinator James Everard said,“Your honor, I’m willing to work with him, but he’s got to try harder.”
Judge Howard Sullivan spoke to the defendant, “I want to hear from you, Mr. Ryan. I have your life in my hands and on my mind.” Ryan stood before the court and muttered he had nothing to say, but with the urging of his attorney, Ryan made a brief and humbled plea to the court, saying, “I would like another chance.”
Sullivan gave Ryan that chance, ordering him back to treatment court and issuing him a stern warning that the 20-year-old could be sent to prison for one to three years if anymore violations occurred.
