Man pleads not guilty in baby's death

NORWICH – A Cincinnatus man who has been charged with manslaughter in the death of a 16-month-old boy appeared in Chenango County Court Friday.
Jason Sherman, 24, Piety Hill, Cincinnatus, was formally charged with two counts of 1st degree manslaughter (a Class B felony) and 2nd degree assault (a Class D felony). Sherman pleaded not guilty to all counts. Police allege Sherman caused the death of a 16-month-old child, Marshal Lee Barber Jr.
On Nov. 10, 2006 at about 7 a.m., Sheriff’s deputies responded to 109 Loomis Lane in the Town of Pitcher, where Sherman was the live-in boyfriend of the child’s mother, to investigate the death an infant. Barber was taken to Chenango Memorial Hospital, where he was pronounced dead by emergency room doctors.
“There was suspicion from the start. The child showed signs of abuse and the wound that ultimately ended his life was a mystery and could not be explained, so flags went up,” said Sheriff Thomas Loughren. The autopsy eventually concluded the official cause of death was “blunt head trauma and asphyxiation.” The death was ruled a homicide.
The court assigned Public Defender Peter J. McBride as defense counsel because Sherman could not afford his own attorney. The defense asked for bail to be reassessed from its current $500,000 cash bail and $1 million property bond. McBride said Sherman has never been in any prior legal trouble and that the mother of the deceased infant is still living with Sherman and does not hold him responsible for her child’s death. Also Sherman works on a farm in Cortland County, McBride said, living with his mother and father and processes no car or driver’s license.
“In order to defend himself adequately, my client needs to be released and indeed to my understanding the circumstances of this case will rely heavily on the expert testimony of medical opinion,” said McBride.
District Attorney Joseph McBride said this was a very violent assault and smothering and the case included a history of violence. The DA revealed that the baby had a broken arm and he believed that the injuries were inflicted in Sherman’s punishment of the child.
The court ruled that Sherman continue to be held at the Chenango County Correctional Facility on $500,000 cash bail and $1 million property bond.
