Defendant's statement admissible in court
NORWICH – In an effort to decrease the amount of information the prosecution can use against him, a man charged with rape went before the court Monday.
James C. Pruitt, represented by county Public Defender Alan Gordon, motioned the court to disregard his statement to state police. Pruitt, who has been charged with rape in third degree, allegedly had sexual intercourse with a 13-year-old girl in July of 2007.
Monday, State Police investigator Jason M. Bessett was asked to take the stand for questioning during the roughly 45 minute hearings. Bessett said within a couple days following the incident he was contacted by Binghamton state police about an incident occurring in Coventry off of Route 235 in the county of Chenango.
Upon questioning, Bessett said the defendant gave him his own rendition of what happened and told of the details leading up to the alleged rape. Bessett said Pruitt, who was 27 at the time, said the girl had told him she was older than her real age and the sex was completely consensual.
When asked by the defense of the defendant’s demeanor while being investigated, Bessett said, “At one point he said he wished he never had sex with her.”
According to Bessett the defendant also stated he had been depressed and drinking prior to the incident. Following questioning by the defense and cross-examination by the prosecution, Supreme Court judge Kevin M. Dowd said the statement given to Bessett at the time of questioning would be admissible in court. As for Pruitt’s criminal history, the judge reserved judgment until a later date.
