County agencies working to help jailed elderly man

NORWICH – A number of county agencies are working toward a solution to help an 85-year-old man who was arrested at his nursing home for public lewdness.
The elderly man, Leonard Bentley, was a resident at The Chase Memorial Nursing Home in New Berlin and was arrested by sheriff’s deputies Friday after the staff contacted police and filed a complaint. Bentley was charged with a class B misdemeanor for exposing himself to residents at the facility.
Town of New Berlin Justice Joseph Brillinger remanded him to the Chenango County Correctional Facility on $1,000 cash bail following his arrest Oct. 3.
The county jail reported Thursday morning that Bentley was still being held.
Assistant District Attorney James P. Chamberlain said the DA’s office had intentions to release Bentley yesterday.
Chamberlain said he was working out release arrangements for the “elderly gentleman,” who may suffer from dementia, when concerns were raised on the defendant’s behalf by his counsel regarding his personal safety and the safety of others because he apparently had nowhere to go.
Public Defender’s Office Administrator Karri Beckwith said, “ The county is diligently working to resolve the situation, because the defendant is unable return to his previous residence.”
County Court Judge W. Howard Sullivan ordered a mental health evaluation of the 85-year-old at the request of the Public Defender’s Office.
Chamberlain reported Tuesday that Bentley, “may have dementia and suffers from mental health issues.”
Attorneys from both sides met with mental health and social services representatives Wednesday in an attempt to work out an a solution.
Bentley’s public defender, Kayphet Mavady, said he was assigned to the case yesterday afternoon and prior to that, Bentley had no legal representation. Mavady said he had no comment and was meeting with his client for the first time later this afternoon.
Chase’s Administrator and CEO Roger J. Halbert said yesterday that staff at the facility had previous concerns regarding Bentley and that the facility acted to protect the other 79 residents living there.
Bentley will appear again at 5 p.m., Oct. 14, in Village of New Berlin Court.
