Oxford teen to appear in county court to face felony charges for desecration and burglary

NORWICH –The oldest suspect in a group of teenagers arrested for desecrating an Oxford cemetery and breaking into the village’s library will appear in county court to face felony charges.
First Assistant District Attorney Stephen M. Dunshee said Devan Ellsworth, 18, of Greene Street, Oxford, had consented to waive his right to a grand jury and head straight to Chenango County court to face the charges against him.
Dunshee said his office received notice from Ellsworth’s assigned attorney, Linden D. Summers giving consent to be prosecuted based on his superior court information.
Dunshee said Ellsworth will face felony cemetery desecration and burglary in addition to two misdemeanors of criminal mischief and conspiracy.
“An S.C.I. is a consent rather than a grand jury indictment and in court it is basically the same as a jury indictment,” he said.
Ellsworth’s alleged co-conspirators, ages 16 and 17, pleaded guilty to fourth degree criminal mischief and were released into the custody of their parents Nov. 3
The teens were arrested Oct. 20 for allegedly using a shovel and spade to knock over 30 headstones at St. Joseph’s Cemetery after unsuccessfully trying to dig up a grave. Police say the teens then headed to the library, where they broke in and stole a donation box full of change last on the same night of the desecration, Oct. 16 at around 1:30 a.m.
A final calculations of the damages has not yet been completed by the Syracuse Diocese that owns the Catholic cemetery, but law enforcement officials have said it would be over $30,000.
