26-year old man who had a 14-year-old girlfriend sentenced to jail over sex crimes

NORWICH – A 26-year-old Norwich man pleaded guilty to having a sexual relationship with a 14-year-old girl and was given a split sentence of six months in jail and 10 years probation.
Domineco R. Spinella, 26, Borden Ave., pleaded guilty to the top felony charge against him, second degree criminal sexual act, a Class D felony.
Spinella appear in court Friday and requested to begin serving his time immediately. He reported to the Chenango County Correctional Facility following his sentencing in court.
He will spend the next six months in the local jail and then will spend the next 10 years on probation and must register as a sex offender for at least the next 20 years.
Spinella was arrested in August in the Town of Norwich for second degree criminal sexual act, sexual misconduct, two counts of forcible touching and endangering the welfare of a child. The incidents are alleged to have happened at the Oxford pool and at a Village of Oxford residence in July and March.
Police said the defendant had an ongoing relationship with the 14-year-old girl, who told investigators Spinella was her boyfriend. Police said the two originally met through a mutual friend.
“If convicted again in the next 10 years of any felony, I want you to understand sir that the law requires that you go to state prison,” said District Attorney Joseph A. McBride. McBride said that if Spinella got in trouble while still on probation, then the court could reject the plea arrangement and have him sentenced to up to seven years in prison.
Public Defender Alan E. Gordon told the court Spinella was employed full-time and wished to continue working, had no prior criminal record except for a misdemeanor conviction in 2002, and would live with his parents. Gordon also reminded the court that the alleged acts were consensual and did not involve any force or violence.
At an earlier appearance, Assistant District Attorney Stephen M. Dunshee said that Spinella’s prior conviction involved “similar predatory circumstances.” Dunshee said he pleaded guilty to endangering the welfare of a child in 2002 and at that time the 20-year-defendant got cut a break because of his age and lack of a criminal record.
Spinella will again appear in court at a later date to determine his sex offender risk level, which will rate him one to three, three being the highest, on the likelihood of committing another sex crime.
