Grand jury charges 19 felonies
NORWICH – The Chenango County grand jury met last week and handed up several criminal indictments.
At the proceedings, the District Attorney’s Office presents evidence against those it wished to prosecute and the jury decides if there is enough reasonable cause to charge a person.
Only felony level crimes appear before the grand jury and the cases are heard by the County or Supreme Court Judge. A total of 19 felonies and a handful of lesser offenses were filed against eight defendants, many of them related to the abuse of alcohol.
• James A. Vitarius, 62, was indicted Wednesday on seven felony sex crimes, including four counts of second degree criminal sexual act (D felonies), three counts of third degree criminal sexual act (E felonies) and endangering the welfare of a child, a misdemeanor. The charges concern an incident that took place about eight years ago in December of 2000 and the spring of 2001 in which Vitarius allegedly had sexual relations with a girl under the age of 15.
• Robert W. Gallo Jr., 26, of Oxford, was indicted for second degree mischief (D felony) and third degree assault, a misdemeanor. The indictment alleges that at 2:45 a.m. Dec. 6, along Fair Street in the City of Norwich, Gallo beat a female victim causing severe pain and bruising to her rib cage before he began striking the victim’s car causing $2,939.43 in damages to the vehicle.
• James N. Booth, 45, was indicted with two counts of driving while intoxicated (E felonies). Police pulled Booth over Dec. 5 in the Town of Bainbridge along State Highway 7 for a traffic offense and claim he was intoxicated with a blood alcohol level over .18. Booth has two prior drunk driving related convictions. On Aug. 27, 2002 and in March of 2004 ,he pleaded guilty to two separate driving while intoxicated charges, both in Town of Guilford Court.
• Frank A. Crawford, 38, was indicted for driving while intoxicated (E felony). Police pulled Crawford over Nov. 23 in the Town of Oxford for a routine traffic offense and claim he was intoxicated. Crawford is being charged as a felon because he pleaded guilty to DWI Dec. 19, 2002 in City of Norwich Court.
• Kenneth H. Doyle, 21, was indicted for first degree failure to register as a sex offender (E felony) after he allegedly missed a 10-day deadline in July to notify officials of his whereabouts.
• Jessica L. Cunningham, 27, was charged with two counts of driving while intoxicated (E felonies) for allegedly driving along State Highway 12 at 1:46 a.m. Jan. 4 in the Town of Norwich. Cunningham has two prior alcohol-related driving offenses, including a guilty plea in Vienna Town Court, Oneida County, of driving while ability impaired on Aug. 27, 2002 and pleading guilty to DWI in Booneville Village Court, Oneida County, on Sept. 8, 2004.
• Sherry L. Taranto, 44, was indicted with two counts of driving while intoxicated (E felonies) and first degree unlicensed operation of a motor vehicle. Taranto was pulled over at 10:22 p.m. Nov. 13, along St. Hwy. 23 in the Town of New Berlin. She has a prior DWI conviction from Chenango Town Court, Broome County, Sept. 10, 2008.
• Terri M. Furgeson, 36, was charged with two counts of driving while intoxicated (E felonies) for an incident that took place at 10:29 p.m., Oct. 9 in the Town of Bainbridge. She has a prior DWI conviction from March 17, 2005 in Chemung County.
