Alleged rape victim speaks on her attacker’s behalf in reducing his sentence

NORWICH – A Sherburne man was sentenced on a lesser charge in Chenango County Court Monday, after his alleged victim spoke out on his behalf.
Twenty-six-year-old Lee Anthony Warner was originally charged with first-degree criminal sexual act, a class B felony, and second-degree assault, a class D felony, and was remanded to the Chenango County jail on $25,000 cash bail by the Sherburne Village Court following his Sept. 5 arrest.
In an agreed-upon disposition, Warner pleaded guilty to second degree attempted assault, a misdemeanor, on Dec. 4 and was sentenced yesterday to six months at the Chenango County Correctional Facility with five years probation. Public Defender Alan Gordon noted in court that the plea did not require his client to register as a sex offender.
“Just the general extended and alcohol conditions apply, get a job and stay out of trouble, you understand,” Gordon told his client in reference to his plea.
Police arrested Warner for allegedly having “forcible deviate sexual intercourse” with a 25-year-old female.
Undersheriff James E. Lloyd said the residence was not known to police for past domestic violence incidents, and said the defendant and the victim had a past personal relationship.
“Due to the very personal nature of the injuries the victim sustained, we are not releasing any details regarding the incident,” he said. “She was taken to Chenango Memorial Hospital following the attack and treated for her injuries there. She was released later that day.”
The injures revealed in court documentation were sustained in the course of an alleged sexual assault.
The victim later appeared in Chenango County Court in December with other family members to plead with prosecutors and the court for leniency on the defendant’s behalf.
“The defendant should absolutely be thanking the victim in this matter who begged and pleaded. What he did to the victim was horrendous,” said District Attorney Joseph McBride in court Monday. “Without her request, the sentence of jail time or probation would not have been appropriate.”
Warner was released Dec. 4 after he pleaded guilty to misdemeanor assault in an agreed-upon disposition. His mother and the victim asked Chenango County Court Judge W. Howard Sullivan to allow him to come home for the holidays.
Following his 11 a.m. appearance, Sullivan ordered Warner to appear at the Chenango County Correctional Facility at 2 p.m. Monday to begin his sentence.
