Grand jury indicts six
NORWICH – The Chenango County grand jury met last week and handed up criminal indictments against six individuals for a total of nine felony charges.
At the proceedings, the District Attorney’s Office presents evidence against those they wish to prosecute as a felon and the jury decides if there is enough reasonable cause to charge a person.
An indictment is not a conviction and defendants will appear in Chenango County Court at a later date to answer to the charges.
Five of those indicted last week are between 20 and 26 years old; five have criminal records, three of them with prior felony convictions.
• Daniel Sabines, 23, of Bradley Hill Road, Oxford, and Anthony J. Pierce, 21, of Bloomfield Road, were both indicted for second degree burglary, a C class felony, after the two parolees allegedly went door to door with a fake political petition and then entered a home when no one answered, according to the Norwich City Police Department.
Police said the two coconspirators were confronted by the homeowner and fled.
According to the New York State Division of Parole, both men were recently released from prison on previous burglary charges less than two months ago. Sabines was released on June 1 and Pierce was released on July 2.
The incident occurred Aug. 16 at around 12:40 p.m. at a residence on Beebe Avenue. Police said the men had approached other homes in the area with their petition before entering the victim’s house.
• Lee A. Warner, 26, Sherburne, was indicted for first degree vehicular assault, a D class felony, aggravated driving while intoxicated and DWI, class E felonies.
According to the indictment, Warner was intoxicated, driving with a 3-year-old and two women in his vehicle. Police said he pulled over and ordered the three occupants from the vehicle during a heated dispute.
While one of the victims was exiting the vehicle, it began to pull away causing her to fall. Her leg was run over, causing serious injury, according to the indictment.
The Chenango County Sheriff’s Office said two of the victims riding in the car had active orders of protection forbidding Warner from having contact with them.
Police said Warner then left the women and the infant along the road, but was picked up 15 minutes later by a Sheriff’s patrol in North Norwich, allegedly intoxicated. Warner was charged with an additional aggravated DWI because he allegedly operated a motor vehicle with a person less than 15 years old in the car, reported the indictment.
The indictment also stated Warner was previously convicted of DWI in 2008 in Town of Smyrna Court.
• Joshua A. Mott, 26, Utica, was indicted for failing to notify law enforcement of an address change after he moved into a new residence from a Norwich address without contacting police. The indictment reported Mott was assigned the highest level of risk assessment in repeating a sex offense, level three. Mott was convicted of third degree rape Nov. 16 after allegedly have sex with a girl under the age of 17.
• Ian L. Borowski, 32, 8 Bridge St. Unadilla, was indicted on two counts of second degree burglary, petit larceny and possession of a hypodermic instrument after allegedly breaking into two different homes.
According to the indictment, on Aug. 18 Borowski entered a residence in the Paddock Trailer Park in Bainbridge and stole a $600 rifle. He is also accused of entering a Town of Guilford home along Gospel Hill Road on Aug. 23.
The indictment said police uncovered three illegal hypodermic syringes from Borowski during his arrest.
• Bryant B. Swingle, 20, Bainbridge, was indicted as Borowski’s coconspirator in the Aug. 23rd Guilford home invasion, and is facing a single count of felony burglary. Swingle was also indicted earlier in the year on a separate count of third degree burglary, for an alleged Sept. 2009 burglary in the Town of Oxford.
