Armed robbery suspect pleads guilty, receives week-long furlough

NORWICH – A 24-year-old Harpursville man arrested for the hold-up of the Bainbridge Great American in 2010 pleaded guilty to first degree burglary, a class B felony, on Friday, prior to receiving a week-long furlough to spend time with his children and family.
Anthony R. Botte Jr., was one of two accomplices accused of the robbery-at-gunpoint, which occurred on Nov. 28 of last year. A plea deal, accepted by Botte on Friday, will send him to state prison for the next five years.
He will also receive five years of post release supervision as part of the deal.
Botte’s attorney, Frank Revoir, originally requested a two-week furlough for his client, who he said has remained incarcerated since late February. He has not been with – or seen – his two children, ages three and one, since that time, added Revoir, who said he’d had “numerous discussions” with his client regarding the restrictions he would face if the furlough was granted.
District Attorney Joseph McBride argued against the furlough, and said the DA’s office had information regarding Botte’s potential to flee the county or state. His co-conspirator during the Bainbridge Great American hold-up, Jamie L. Ballard, was arrested in Florida in early May of 2011.
If he were to run – or commit another crime – Botte could face up to 25 years in state prison, added McBride.
Judge W. Howard Sullivan said he would consider a week-long furlough, rather than the two requested, and granted it on the condition that Botte remain at his parent’s residence. He also charged Botte with contacting the county’s Drug Court representative James Everard throughout the week leading up to his formal sentencing on Oct. 14. Sullivan added that Botte would be tested for any alcohol, marijuana or controlled substances when he returns to court.
“If you don’t show up ... a warrant will be issued,” stressed Sullivan, prior to granting the furlough. “If you don’t show up ... you will pay the price.”
In addition to five years in state prison and five years post release supervision, Botte will have to pay approximately $2,400 in restitution for the armed robbery that occurred in November of 2010.
