Five sentenced in county court Monday

NORWICH – Five people charged with various felonies accepted plea deals in county court on Monday and were subsequently sentenced for their respective crimes.
• Bradley Romano, 27, of Sidney, was sentenced to four years in state prison after pleading guilty to one charge of menacing a police officer, a class D felony.
In January of 2011, Romano was indicted on that charge, in addition to third degree criminal possession of a weapon, a class D felony, two counts of fourth degree criminal possession of a weapon and one count of resisting arrest.
On Dec. 13, 2010 New York State Police responded to 1472 County Route 35, Guilford, in an attempt to locate Romano, who was wanted on a bench warrant for second degree assault, a class D felony. Once located – and prior to his arrest – Romano admitted to pointing a 16-gauge shotgun at troopers.
Chenango County District Attorney Joseph McBride told the court Romano was lucky the troopers involved in the incident restrained themselves and said the defendant “needs to understand that day could have been one of the worst in the history of Chenango County.”
Romano was granted a one week furlough to spend time with his family. If he were to violate the terms of his release, Romano could face up to seven years in state prison.

• Amanda Hamilton, 27, of East Pharsalia, was sentenced to five years probation after pleading guilty to one count of third degree grand larceny, a class D felony.
Hamilton was arrested in July of 2011 in connection with the theft of more than $4,600 in postal money orders from the East Pharsalia Post Office, where she had been employed. She must also pay restitution in the amount of $4,640, to be paid on or before May 1 of 2012.

• Trevor Collins, 18, of Oxford, was sentenced to ten years probation after pleading guilty to third degree rape, a class E felony, and must register as a sex offender. Collins was taken into police custody in August of 2011 after he allegedly engaged in sexual intercourse with a 16-year-old relative without her consent.

• Justin Townsend, 23, of Guilford, was sentenced to six months in the Chenango County Correctional Facility – with credit for time served – after pleading guilty to one charge of second degree attempted burglary, a class D felony.
In November of 2011, Townsend was arraigned on charges of second degree burglary, third degree grand larceny and petit larceny following an incident that occurred in the City of Norwich.

• Ashvil Rood, 35, of Pitcher, was sentenced to five years probation and must complete the Chenango County Treatment Court program after pleading guilty to aggravated driving while intoxicated, a class E felony. He must also serve 30 days of community service, mandatory due to the aggravated charge. According to the county district attorney’s office, this is Rood’s fourth driving while intoxicated charge.

The court’s sentencing of Shawn Fowlston, 27, of Norwich, was postponed to allow for additional testing of an adulterated urine sample submitted by the defendant following a court-approved furlough. Fowlston was remanded to the Chenango County Correctional Facility pending the results of that testing and – if results show the defendant attempted to mask the presence of an illegal substance – could face up to three and a half years in state prison. If not, Fowlston will serve an agreed upon sentence of two and a half years in state prison.
On Jan. 20, Fowlston pleaded guilty to one count of first degree sexual abuse – a class D felony – after admitting he subjected another individual to unwanted sexual contact, restraining her against her will while using physical force. He has also been sentenced to ten years post release supervision and must register as a sex offender once released from state prison.
Judge W. Howard Sullivan also issued a warrant for the arrest of Tommy Kessinger, who was scheduled to appear in court for the purpose of an attorney conference and possible sentencing. In April of 2011, Kessinger, 24, of Smyrna, was indicted on charges of first degree sexual abuse – a class D felony – and endangering the welfare of a child.
