Five appear in County Court

NORWICH – Five individuals appeared in Chenango County Court Monday afternoon, three pleading not guilty to the charges brought against them, one admitting to having violating the terms and conditions of his conditional discharge, while another pleaded guilty to fourth degree grand larceny.
• Domenico D. Finkbiner, 18, Sidney, pleaded not guilty to two counts of second degree robbery, a class C felony; one count of second degree assault, a class D felony; and one count of second degree menacing, a class A misdemeanor. The defendant was released on his own recognizance and ordered by the court to remain at his mother’s home in Sidney for the duration of the proceedings. An order of protection was also issued in favor of the alleged victim.
It’s alleged that, while acting in concert with another, Finkbiner did physically injure an individual during the commission of an alleged robbery. Furthermore, what appeared to be a firearm is alleged to have been displayed and pointed at the back of the victim’s head.
After filing the People’s trial-ready notice, Chenango County First Assistant District Attorney Stephen M. Dunshee stated that – due to the violent nature of the crime – bail should be set at $25,000 cash.
Countering Dunshee’s assertion, defense attorney Michael Korchak argued that – because the incident in question was a fight over a controlled substance – Finkbiner’s age makes him eligible for youthful offender status, noting the defendant has a limited criminal history and has ties to the community.
• Ryan V. Lewis, 22, Afton, pleaded not guilty to two counts of second degree vehicular assault, a class E felony; and driving while intoxicated. He was granted a continuance of his R.O.R. statues.
The charges stem from an incident which took place February 24 in the Town of Afton. It is alleged that Lewis was operating a 2006 Subaru Impreza on Afton Lake Road when the vehicle left the roadway and hit a tree. One passenger was pronounced deceased at the scene and two others were transported to Wilson Regional Medical Center in Johnson City with non-life threatening injuries.
• Jeremy M. Sawyer, 36, Norwich, waved his right to be prosecuted by indictment and pleaded not guilty to charges of third degree aggravated unlicensed operation and felony driving while intoxicated. He was remanded to the Chenango County Correctional Facility on a probation hold without bail, as well as $20,000 cash bail for the new charges he faces.
• Kevin Urgo, 35, Oxford, admitted to having violated the terms and conditions of his conditional discharge by operating a 1998 red Chevy Blazer with a Kentucky license plate without a properly equipped interlock. He will re-appear in court at a later date for sentencing.
• Leslie C. Woodward, 33, Binghamton, pleaded guilty to the class E felony of fourth degree grand larceny. Restitution will be determined at the time of sentencing, which will be held at a later date.
It was alleged that Woodward, while living with her boyfriend and his mother in Plymouth, did steal and sell jewelery worth approximately $1,770.
