Alleged felon already facing multiple charges arrested once again, remanded to the CCCF on $10,000 bail

NORWICH – A man accused of growing large amounts of marijuana on his property on multiple occasions appeared once again in Chenango County Court Monday.
Henry W. Hemsley, 74, Norwich, appeared in court after being arrested on a warrant issued by Chenango County Court Judge Frank B. Revoir Jr. on Aug. 7 for allegedly cultivating a marijuana plant in plain view on his lawn. Already released on bail for a pending matter involving 45 marijuana plants, several pounds of processed marijuana, and some 200 long guns, Hemsley was remanded back to the Chenango County Correctional Facility on $10,000 cash bail or $100,000 property bond.
Hemsley is currently facing charges stemming from three separate incidents.
On Sept. 7 of 2012, the Chenango County Sheriff’s Department executed a search warrant at Hemsley’s county Road 32 residence in the Town of Norwich. During their search, authorities allegedly found 45 marijuana plants as well as two pounds of processed marijuana, and more than 200 long guns including some high profile weapons. Among the weapons seized were two fully automatic AK-47 assault rifles – the second oldest assault rifle variant and the most produced weapon of its class in the world; a fully automatic M16 assault rifle, the United States’ military version of the civilian AR-15; a .44 Vietnam Commemorative Revolver; a .45 caliber Colt M1911 handgun, dubbed the Model 1911 as it was first adopted by the United States military in 1911 and is still issued to select groups of soldiers; a .41 caliber Smith & Wesson Revolver, similar to the weapon wielded by the infamous Dirty Harry; a semi-automatic 9mm Taurus handgun; a .22 Dan Wesson revolver; a .22 caliber Ruger Mark II revolver; and a .22 caliber Marlin Handgun. The lawful search of Hemsley’s property in September resulted in the following charges being filed against him: second degree criminal possession of marijuana, a class D felony; six counts of third degree criminal possession of a weapon, a class D felony; and seven counts of fourth degree criminal possession of a weapon, a class A misdemeanor. He was indicted on those charges in December. A hearing on the matter has been scheduled for later this year.
On March 3, 2013, Hemsley was arrested again and charged with petit larceny and trespassing following an incident inside the Norwich Wal-Mart. Those charges are still pending in the Town of Norwich Court.
On August 7, 2013, a warrant for violating the conditions of his release for the possession of weapons charges was issued by Chenango County Court after a sheriff’s deputy allegedly observed a marijuana plant growing in his lawn on July 31 of this year.
In an unrelated matter, Hemsley was also arrested in 2008 following a tip which led to the sheriff’s office collecting a copious number of marijuana plants which had allegedly been growing behind Hemsley’s house.
During Monday’s court proceeding, a wheelchair bound Hemsley appeared without a lawyer and bail was set for $10,000 cash.
“I don’t get to make a plea myself,” asked Hemsley, interrupting the proceedings.
“No you do not,” responded the judge.
After setting bail, Revoir stated he would be willing to review the subject of bail again at a later date once the defendant had secured legal counsel.
