13 indicted by grand jury

NORWICH – The Chenango County grand jury handed up a number of criminal indictments on Wednesday. At a grand jury proceeding, the Chenango County District Attorney’s Office presents evidence against those they wish to prosecute. It is up to the jury to decide if there is enough reasonable cause to charge a person with a felony offense.
Those indicted by the grand jury are arraigned before the county or Supreme Court judge at a later date.
The grand jury indicted 13 individuals:
• Tafari J. Simmons, 19, of Brooklyn, was indicted on two counts of third degree criminal possession of a controlled substance, a class B felony; and one count of fourth degree criminal possession of a controlled substance, a class C felony.
Allegedly Simmons, at approximately 1:52 p.m. on June 5, 2013, had 23 individually wrapped packages containing the narcotic drug cocaine, at 8 Mechanic Street in the City of Norwich. It is believed Simmons intended to sell the packages containing a total of 4.52 grams of cocaine as well as five individually wrapped packages of the narcotic drug heroin.
• Thomas E. Bates, 45, of Norwich, was indicted on the charge of driving while ability impaired by drugs, a class E felony.
It’s alleged Bates, at approximately 12:47 p.m. on March 26, 2013, operated a 1999 Honda Civic while his ability to do so was hampered by drugs on County Road 32 in the Town of Norwich. During a vehicle stop, Bates failed a field sobriety test, was observed to have glassy eyes. Following the traffic stop he also tested positive for Oxycodone.
In January, 2009, Bates was convicted of misdemeanor driving while intoxicated in the Norwich City Court.
• Christopher M. Bennett, 40, of Symrna, was indicted on two counts of fourth degree grand larceny, a class E felony; and one count of petit larceny, a class A misdemeanor.
It is alleged that Bennett stole two wallets from two separate individuals, each of which contained credit cards and debit cards. One of the wallets also contained $400. According to his indictment, the alleged crimes took place at approximately 4:30 p.m. on July 20, 2013, at Denny’s Bar located at 75 North Broad Street, in the City of Norwich.
• Christopher R. Cox, 31, Utica, was indicted on one count of third degree criminal sale of a controlled substance, a class B felony; third degree criminal possession of a controlled substance, a class B felony; and fifth degree criminal sale of a controlled substance, a class D felony.
According to his indictment, Cox had two glassine envelopes containing the narcotic heroin on May 24, 2013, at the Quickway located on State Highway 12 in the Village of Sherburne. He is also accused of intending to sell the heroin.
• Desiree S. Prosser, 26, Norwich, was indicted for first degree promoting prison contraband, a class D felony.
Allegedly, Prosser mailed a card containing heroin to an inmate of the Chenango County Correctional Facility in the Town of Norwich on June 8, 2013.
• Joshua C. Trask, 23, Sherburne, was indicted for third degree criminal possession of a controlled substance, a class B felony; first degree criminal nuisance, a class E felony; and seventh degree criminal possession of a controlled substance, a class A misdemeanor.
According to court papers, Trask, while collaborating with another individual, maintained a place where controlled substances were exchanged, which he derived a benefitted from. He is also accused of possessing heroin and intending to sell the drug. All of these accusations are alleged to have occurred on March 28, 2013, at 5A Knapp Street in the Village of Sherburne.
• Jennah I. Shreve, 21, Sherburne, was indicted for third degree criminal possession of a controlled substance, a class B felony; first degree criminal nuisance, a class E felony; and seventh degree criminal possession of a controlled substance.
It is alleged that on March 28, 2013 at 5A Knapp Street in the Village of Sherburne, Shreve “did knowingly conduct or maintain a premises, place or resort where persons came or gathered for purposes of engaging in the unlawful sale of controlled substances in” and that she derived a benefit from said sales. Furthermore she is accused of possessing and planning to sell the narcotic drug heroin.
• Devan A. Ellsworth, 23, Norwich, has been indicted on two counts of third degree burglary, a class D felony, and two counts of petit larceny.
It is alleged that on August 2, 2013, at the Adult World Store located at 6090 State Highway 12 in the Town of Norwich, Ellsworth broke into the establishment and stole $626.94. It is also alleged that he did it a second time, on August 8, 2013, and stole and additional $267.
• Matthew P. Bigelow, 29, Sherburne, was indicted for third degree criminal possession of a controlled substance, a class B felony; and fourth degree criminal possession of a controlled substance, a class C felony.
Ostensibly, at 9:45 p.m. on May 12, 2013, on Canasawacta Street in the City of Norwich, Bigelow was in possession of 12.93 grams of the narcotic drug cocaine and that he intented to sell it.
• Michael R. Pollock, 44, Pharsalia, was indicted for first degree aggravated unlicensed operation of a motor vehicle, a class E felony; operating a motor vehicle while he had .08 of one percentum or more by weight of alcohol in his blood, a class E felony; and DWI, a class E felony.
It is alleged that at approximately 9:45 p.m. on July 18, 2013, on County Road 10 in the Town of Preston, Pollock drove a 2004 Ford with a blood alcohol content of .14 percent, as shown by a chemical analysis of his breath.
He has two prior convictions, a March 2010 DWI misdemeanor, and a October 2004 DWAI-Alcohol conviction, both in the City of Norwich Court, making his present DWI indictment is a felony charge.
• James C. Johnson, 38, Binghamton, was indicted for first degree aggravated unlicensed operation, a class E felony; operating a motor vehicle while he had .08 of one percentum or more by weight of alcohol in his blood, DWI felony; and fourth degree criminal possession of a weapon, a class A misdemeanor.
Allegedly on July 12, 2013, at approximately 8:46 p.m. on County Road 9, in the Town of Greene, Johnson operated a 2007 Volkswagen Jetta while his ability impaired by a .09 blood alcohol content level and while he was aware that his license had been revoked or suspended. He also allegedly had a set of metal knuckles his pants’ pocket.
He has a previous DWI misdemeanor conviction from July 11, 2007 in Binghamton.
• Stacey A. Truesdail, 31, Greene, was indicted for second degree burglary, a class C felony; fourth degree grand larceny, a class E felony; and petit larceny.
Allegedly, on July 10, 2013, at 11 a.m. at 670 Hotchkiss Road in the Town of Greene, Truesdail broke into a residence. Once inside she allegedly stole two 14 karat gold rings with diamonds, a 14 karat gold necklace, 18 karat gold necklace, an 18 karat gold ring with an oval surface, a jade pendant, and approximately $100. The jewelery as an estimated value of $1,780.
• Kyle W. Braman, 28, Binghamton, was indicted on charges of second degree rape, a class D felony; second degree criminal sexual act, a class D felony; and endangering the welfare of a child, a class A misdemeanor.
It is alleged that Braman, while being over the age of 18, at approximately 8:30 p.m. on July 7, 2013, engaged in various sexual acts with a female who was less than 15 years old, at an East State Street residence in the Village of Sherburne. Furthermore it is alleged that said acts are likely to have been injurious to the physical, mental, or moral welfare of the victim.
