Sex offender and others appear in court

NORWICH – Several appeared in Chenango County Court on Friday for arraignments, pleas and sentencing.

• Gary Cleveland, 58, Oxford, appeared in court for his sex offender risk level determination. District Attorney presented two People's Exhibit documents that determined Cleveland to be a level three sex offender. Cameron stated that his client questioned the number of victims that were listed in the document (two instead of three victims) and also questioned the document's calculation of the duration of the offense. Revoir said he would review all documents, including the pre-plea investigation, and would send his determination in writing. Cleveland was remanded to Cayuga State Prison for the end of his 10 year sentence.

According to a prior Evening Sun article Cleveland, “pleaded guilty to attempted criminal sexual act in the first degree and rape in the second degree for incidents in fall of 2005 during which he sexually imposed himself on young girls.”

• Zachariah J. Zwickel, 35, Norwich, appeared in court for unpaid restitution to his victim in the total of $750.25. Revoir explained that Zwickel had appeared before him numerous times before in regards to unpaid restitution. Zwickel's attorney, John Cameron, explained that Zwickel had misunderstood the terms of his sentencing at his last appearance, but would fully pay the restitution now that he understood the expectations. Zwickel was ordered to put $100 down and pay the remaining balance in full in 60 days. If he has not paid the amount he is scheduled to reappear in court on July 25.
