Level 3 sex offender sentenced for failure to verify
NORWICH – A level 3 sex offender pleaded guilty to the class E felony of failure to register or verify as a sex offender and was sentenced to incarceration in the county jail and probation.
According to the New York State Sex Offender Directory, 38-year-old Todd E. Dewey of 105 Kelsey Brook Park in Afton was classified as a level 3 sex offender after being convicted of attempted rape in the second degree on Dec. 6, 1999 in Chenango County Court.
On Jan. 1, 1999, Dewey – when he was 22-years-old – had sexual contact and sexual intercourse with a non-stranger 12-year-old female victim, per the directory.
On May 11, 2015, Dewey appeared in Chenango County Court and pleaded guilty to the class E felony of failure to register or verify as a sex offender.
He admitted on Jan. 1, 2015, at 105 Kelsey Brook Park in the Town of Afton, he did knowingly create an email account and internet identifier on Facebook, and as of Jan. 26, 2015, he failed to register the email or Facebook account with the New York State Division of Criminal Justice Services Sex Offender Registry within 10 calendar days as he was required to by law.
“While he did not harm anyone, he is a level III sex offender, and he did get on the internet,” said District Attorney Joseph A. McBride. “There is no evidence that he was looking for children or anything, but he should not be on the internet.”
“I respectfully requested he receive a year,” added McBride.
McBride turned to Dewey and said, “[When you get out of jail] if you get on the internet or don't register any changes where you live, then you will go to prison.”
Dewey's public defender John Cameron, requested that his client be allowed to turn himself in on May 26 and begin the incarceration portion of his sentence at that time.
Dewey echoed Cameron's request and said he would turn himself in on May 26 after handling his personal matters.
Judge Frank B. Revoir, Jr. said he reviewed the pre-plea report thoroughly before making his decision. He said Dewey's crime occurred 16 years ago.
“You did your prison sentence and maxed out on your parole. There is nothing to indicate you were out preying upon children or [doing anything else] to harm the community,” said Revoir.
“However [as important as the incarceration] or the probation is, the sex offender registry is just as important because they are monitoring whether or not you are doing what you are supposed to do,” he added.
Revoir said Dewey will serve time in jail for failing to register and will be placed on probation again, because he said Dewey should have known better after 16 years of being a convicted sex offender.
Dewey was sentenced to six months of incarceration at the Chenango County Correctional Facility and five years of probation.
Revoir approved his request to turn himself in on May 26. He will begin the incarceration portion of his sentence on that date.
