Bail set at $25k for Cruz, despite DA’s Office’s higher recommendation

NORWICH – The 23-year-old accused of assault and resisting arrest following Tuesday’s foot chase in the city was arraigned in Norwich City Court Wednesday morning.
Caden Cruz appeared before Judge James Downey for the purpose of bail.
Judge Downey read the information provided to him regarding the felony complaint against Cruz.
It is alleged that Cruz caused injure to a police officer, fought with the officer, and as a result, the officer had a facial laceration requiring eight stitches, Downey explained.
With regard to the misdemeanor charges against Cruz – including resisting arrest – Downey said that it’s alleged he did combat police and attempted to ‘hip toss’ an officer.
It is further alleged that Cruz led a foot pursuit, pushed officers, and jumped a fence.
Downey read the charge regarding the possession of a hypodermic instrument, which alleges Cruz was in possession of a needle with no legal documentation allowing him to possess such instrument.
Downey informed Cruz of his rights in court, and Cruz affirmed that he did indeed want representation.
First Assistant District Attorney Michael Ferrarese provided background to the court and said that Cruz has two outstanding warrants.
“[The injured officer] confronted the defendant, the defendant resisted arrest, physically injured the officer who has a deep gash to the head,” said Ferrarese. “The defendant fled, Officer Carnrike used pepper spray to attempt to get the defendant to comply, it did not work, he climbed a fence, and for about an hour evaded police.”
Ferrarese continued by saying that backup was called and with the help of the other responding agencies, the defendant was taken into custody.
“He is a significant flight risk,” said Ferrarese. “He spent time in California, his family has some assets, and the people request he be remanded with $100,000 cash bail or $300,000 bond.”
It was stated in court that Cruz has three prior convictions and if found guilty in this case, could face a maximum of up to seven years in state prison.
Ferrarese said the bail recommended was not unreasonable “due to the charges.”
Downey then asked Cruz some questions regarding his past and future.
Cruz stated he is currently living with his mother, and said that he was out in California for court ordered treatment. Cruz said he has been back in the area for approximately a month.
“So everyone deserves a fifth chance?” asked Downey.
Cruz indicated he wanted to get involved in local drug treatment panel discussions, but that his outstanding warrants stopped him from getting involved.
Judge Downey then remanded Cruz to the Chenango County Correctional Facility in lieu of $25,000 cash bail, $50,000 bond, or $100,000 real property bond.
A felony hearing is tentatively scheduled for Friday at 1:30 p.m. in Norwich City Court.
It was instructed that if Cruz is able to post bail, that he must report to Jim Everard, Cordinator of the Chenango County Drug Treatment Court.
