Police: Man’s conduct created grave risk of death to another
NORWICH – A 31-year-old Norwich man is accused of recklessly engaging in conduct which created a grave risk of death to another person among various other charges following an incident Thursday, March 24.
Norwich Police Chief Rodney Marsh confirmed that a loaded black powder pistol, a black powder rifle and a knife were recovered from the residence as part of the investigation.
According to authorities, at approximately 2:15 p.m. that Thursday, the Norwich Police Department received a call from the Chenango County Sheriff's Office 911 Center of a domestic dispute at a residence on Sheldon Street.
NPD officers immediately responded, but it was discovered the subject had left the residence prior to their arrival.
Officers began the investigation and the victim was returned to the Norwich Police Headquarters. It was reported that a short time later, the NPD received information that the subject had returned to the residence.
Officers returned to the residence on Sheldon Street and the subject was taken into custody without incident.
James S. McIntosh, 31, Norwich was arrested and charged with the following:
• Reckless Endangerment in the first degree, a class D felony
• Unlawful Imprisonment in the first degree, a class E felony
• Assault in the third degree, a class A misdemeanor
• Menacing in the second degree, a class A misdemeanor
• Criminal Possession of a Weapon in the fourth degree, a class A misdemeanor
• Criminal Obstruction of Breath/Blood, a class A misdemeanor
• Criminal Mischief in the fourth degree, a class A misdemeanor
The reckless endangerment charges allege that under circumstances evincing a depraved indifference to human life, Mcintosh recklessly engaged in conduct which created a grave risk of death to another person.
The unlawful imprisonment charges allege that Mcintosh restrained another person under circumstances which exposed the latter to a risk of serious physical injury.
The assault charges allege Mcintosh intentionally caused a physical injury to another person.
The menacing charges allege that Mcintosh intentionally placed or attempted to place another person in reasonable fear of physical injury, serious physical injury or death by displaying a deadly weapon.
The criminal possession of a weapon charges allege Mcintosh possessed a weapon with intent to use the same unlawfully against another.
The criminal obstruction of breath/blood charges allege Mcintosh intended to impede the normal breathing or circulation of the blood of another person when he applied pressure on the throat or neck of such person.
The criminal mischief charges allege Mcintosh intentionally damaged property of another person.
Mcintosh was arraigned in Norwich City Court and he was transported to the Chenango County Correctional Facility in lieu $25,000 cash bail. He is to reappear at a later date.
