Additional witnesses testify for the prosecution

NORWICH – Various other individuals took the stand as witnesses for the prosecution in the case of the People vs. John M. Guzy. Below are highlights from some of the witnesses.

• Brett Cowen – Attorney
Cowen alleged that he was driving by Peak Fitness the day of the incident and watched as the vehicles were parked and individuals exited the vehicle. “I noticed two vehicles pulled off, not in parking spaces, just pulled off the road,” said Cowen. “The vehicles weren't a great distance apartmaybe 10 to 15 feet. I couldnt hear anything but you could tell it wasnt a calm conversation.”
Bergman was given a chance to question the witness and handed him a copy of the police report that Cowen previously gave. Inside the police report, the distance of the cars and what the altercation looked like were called into question.

• Karen M. Vanmeulen – employee next door
Vanmuelen is a employee of the business next door to Peak Fitness, Silicon Solar, who has claimed to have seen the incident briefly while checking the mail that day. “I glanced to my left and saw three men grappling, atleast 30 to 45 seconds later I heard a pop, pop, pop, and then a car screeching out,” said Vanmuelen.
During a chance for Cross examination Bergman inquired as to how many pops she had heard.
“Five or six, I didnt necessarily recognize them as a gunshot,” said Vanmuelen.

• Judith Denton – Member of Peak Fitness.
Denton alleged to the court that she did only see one vehicle, while also observing an individual on the ground by the vehicle and another individual near the rear of the vehicle.
Denton did perform CPR on Derek D. Prindle at the time, and had said that he was still alive at the time.
“He (Father) said he spat in my face, he hit me with a stun gun. It was an abrasion,” said Denton. “There was a tear in the shirt but I did not see any blood, he (Father) was very pale. It all happened so fast.”

• Jody Genung – Passerby
Genung stated that she was driving back to work following her lunch break when she came upon the incident, where she saw a man overtop another.
“He (Father) said 'he shot my boy,' then he said that a vehicle was driving behind him,” said Genung. “The father told me the guy would kill them both, and that the guy spit in his face, and that it looked like the guy was holding a stun gun or something.”
Genung further alleged that she observed a bullet wound and began looking for an exit where the bullet may have come out of.

• Sarah Arias – Peak Fitness staff
Arias was working as the front counter staff at the fitness center when the incident outside broke out. Arias told the court she assumed it was someone with car trouble, before explaining that she saw the older man (Father) who was very emotional and kept saying 'he was going to kill my son.'
Arias did allege that she saw injuries to the son, Derek D. Prindle, when she discribed “there seemed to be one shot in the stocmach and one shot in chest.”
Arias further explained that she did not see a weapon or hear and gunshots.

• Denise Singler – CPR
Singler was at the fitness center on that day and time, and stated for the court that she observed the father (Derek S. Prindle) use some type of bandage on his injury.
“I kept watching over the man on the ground, the Troopers took over eventually,” said Singler.
During cross examination Bergman questioned Singler as to which vehicle pulled in the parking lot first.

• Megin Ciaccia – Trooper
Megin Ciaccia was the NYS Trooper out of Troop C who first reponded to the scene after receiving a call of a stun gun incident.
“The man (Derek S. Prindle) lifted his shirt and it wasnt a stun gun, it was a gun shot wound,” said Ciaccia.
Ciaccia then attested that she began CPR on the man on the ground (Derek D. Prindle), saying, “there was a wound to the abdomen and chest area, probably an index finger in size, and there was black around the edges.”
Ciaccia further explained that the black around the edges could mean it was gun powder from a close range gun shot.
“I was advised no shock defibrulator, there was no pulse so I continued CPR. I went to the hospital with the rescue squad once they arrived and 20-minutes later they pronounced him dead.
Ciaccia did attest in open court that she saw no weapons or threat when she assessed the situation upon arrival.
