Bond amount increased for accused pharmacy thief

NORWICH – A man who allegedly attempted to steal prescription narcotics from a pharmacy in the City of Norwich appeared in Chenango County Court this week.
Jeffrey Scott Cabral, 27, of South New Berlin, was in Chenango County Court with Public Defender John Cameron for his scheduled court date this past Monday morning.
Cabral had recently been arraigned in the City of Norwich Court before Judge James Downey. However, due to his charges holding felony level weight, his matter was transferred to County Court to appear before Chenango County Court Judge Frank B. Revoir Jr.
The underlying alleged incident occurred on Monday, April 4, 2016, at approximately 11:10 a.m. The Norwich Police Department received a call from the Chenango County Sheriff's Office 911 Center regarding a situation where it was initially reported the suspect may have been armed with a handgun, yet this was found to not be the case.
According to the Norwich Police, a citizen called the 911 Center and reported they were following the suspect’s vehicle at that time. The unnamed citizen stayed on the phone with the 911 Center and continued to report locations and directions of travel, which allowed a New York State Trooper to locate Cabral and his vehicle on Ranch Lane, near Sunset Drive in the Town of South New Berlin.
With a variety of additional law enforcement officers on the scene, Cabral was eventually taken into custody roughly 40-minutes after being located.
At the time of the arrest Cabral was charged with robbery in the third degree, a class D felony; and petit larceny, a class A misdemeanor.
Judge Downey elected to set the bail and bond amounts on the matter at $25,000 cash and $50,000 bond, despite the alleged request $100,000 bail from The District Attorney’s Office.
Now in May, Cabral was back in Chenango County Court to potentially waive his Constitutional right to a grand jury indictment, and instead consent to the District Attorney's Office filing a superior court information (SCI) charging him with one or more felony level offenses.
First Assistant District Attorney Michael D. Ferrarese was present in County Court representing the people on this matter.
The SCI from the DA's office held true to the original charges and once again charged Cabral with robbery in the third degree, a class D felony; and petit larceny, a class A misdemeanor.
Cabral's Attorney, Cameron, opted to waive a formal reading of the charges and entered not-guilty pleas to both of the charges.
At this time Ferrarese filed his affidavit of service and notice of intent for trial with the clerk of the court.
“At this time the people request that bail remain at $25,000 and bond be set at $100,000. This defendant has a history out of state, he is not from around her, and just recently moved here with his family,” said Ferrarese. “He has been arrested by seven different agencies in the state of Rhode Island, so for that reason he is a flight risk.”
Cameron asked for reasonable bail and bond to be set for his client, alleging that Cabral's wife is originally from around the Chenango County area.
Judge Revoir did elect to grant the DA's request and subsequently kept the bail amount of $25,000 the same, while increasing the bond amount from the original $25,000 to the new amount of $100,000.
A pre-plea order was signed to conclude the court case for the day.
