Man sentenced to State Prison for third DWI in five years

NORWICH – The case of Jeremy M. Sawyer was heard when the Chenango County Court convened for a morning session on Friday, Jun. 3. Assistant District Attorney Laura Parker represented the people of Chenango County, while The Honorable Judge Frank B. Revoir Jr. presided over the case.
On Jan. 13, 2015, around 7 p.m., the Chenango County Sheriff’s Office 911 center received a call from a Norwich resident claiming that his 2003 GMC pick-up had been stolen about 20 minutes earlier.
At approximately the same time that day, Chenango County Sheriff’s Deputies and the village of Sherburne Police Department were assisting in the removal of a tractor trailer that had slid into a ditch near Shawler Brook Road, in the Town of Sherburne.
It is alleged that while authorities were assisting with the removal, a pick-up truck drove around the northbound traffic barrier and crashed head-on into a vehicle heading southbound. Upon investigation, it was found that the driver of the pick-up was Sawyer.
Sawyer was allegedly unable to exit his vehicle, and authorities had to extinguish flames that had engulfed the front of the pick-up truck. During the investigation of the accident, authorities determined that Sawyer was driving the 2003 GMC pick-up that had been reported stolen earlier that day. He was arrested on charges of driving while intoxicated, a class E felony; aggravated unlicensed operated of a motor vehicle, a class E felony; and unauthorized use of a mother vehicle in the second degree, also a class E felony.
When Sawyer appeared in County Court, he agreed to enter a plea of guilty to the charges of driving while intoxicated, a class D felony, and aggravated unlicensed operation of a motor vehicle in the second degree, a class E felony.
Sawyer is a predicate felon, who already has two previous felony DWI convictions within the last five years,
After he was sworn in, Judge Revoir asked Sawyer if he was the one operating the 2003 GMC pick-up on Jan. 13, 2015, to which Sawyer replied yes. Revoir then asked him if he was involved in an accident that day, to which Sawyer replied yes. Revoir proceed to ask Sawyer if he consumed alcohol prior to the accident, to which Sawyer said yes. He also asked Sawyer if he was intoxicated, to which Sawyer said, “I can’t state for any certainty that I was, but I believe so.”
After Judge Revoir was satisfied with these admissions, he gave a chance for Parker to speak on behalf of the people. She said, “This is Mr. Sawyer’s third DWI conviction. He needs to spend time in State Prison. He took a car that was not his and drove it (in an) intoxicated state and got in an accident. He puts his own interests in front of society’s. Hopefully State Prison teaches him that he can’t do this.”
When Sawyer was given the chance to speak on his own behalf, he said, “I would like to apologize to the court and to the people for my actions. They are regrettable. I’m glad that nobody was seriously injured. Experience is the best teacher. From the experiences that I’ve had, I’ve learned a lot.”
Judge Revoir sentenced Sawyer to one and a half to four years in State Prison for the felony DWI charge, and sentenced him to a three year conditional discharge for the second charge of aggravated unlicensed operation of a motor vehicle. Sawyer will also have to pay restitution of $2150, which will be enforced in payments of at least $75 a month, beginning three months after his release. His driving priveleges were revoked for a year, and he will have to install an ignition interlock in his car, for which he will be assessed fifty percent of the cost.
A written waiver of appeal was signed at the conclusion of the matter.
