Woman sentenced to six months for Division Street meth bust

NORWICH – The case of Stephanie S. Vierkant was heard when the Chenango County Court convened for a morning session on Friday, June 10. Assistant District Attorney Laura Parker prosecuted the case for the people of Chenango County, while The Honorable Judge Frank B. Revoir Jr. presided over the matter.
According to authorities, it was alleged that on Dec. 21, 2015, the Norwich Police Department received a ‘loud noise’ complaint from a residence on Division Street at approximately 9:17 p.m. It was reported that the residents were outside yelling and swearing at each other and that someone was excessively honking a car horn. NPD officers then responded to the scene where they made contact with several individuals. During the investigation that ensued, officers observed what they believed to be a ‘one-pot’ methamphetamine cooking container in plain view. Authorities additionally said the officers observed numerous precursors for the production of methamphetamine.
Following an investigation, it was determined that Freeman J. Deabay III, 44, of Oxford and Vierkant, 34, of Norwich, were unlawfully manufacturing methamphetamine at their residence located on Division Street in the City of Norwich. During the course of the investigation, a ‘one-pot’ methamphetamine cooking container was located inside the residence, along with numerous chemicals, accelerants and byproducts. The Norwich Police requested the assistance of the New York State Police – CCERT (Contaminated Crime Scene Emergency Response Team), who remained on the scene for several hours collecting evidence.
Vierkant originally faced charges of unlawful manufacturing of methamphetamine, a class D felony; criminal possession of a controlled substance in the seventh degree, a class A misdemeanor; endangering the welfare of a child, a class A misdemeanor; and criminal nuisance in the second degree, a class B misdemeanor.
In a plea deal with the DA's office, Vierkant agreed to enter a guilty plea to the top charge of unlawful manufacture of methamphetamine in the third degree, a class D felony. In that plea deal, she also agreed to testify in any future court proceedings against her then boyfriend Freeman J. Deabay III.
After Vierkant was sworn in, Judge Revoir asked her to summarize her involvement in the alleged manufacturing of meth at the residence on Division Street.
Vierkant said, “It was done in a basement.” When asked how long she was allegedly cooking meth at the residence, Vierkant said about two months.
Judge Revoir was satisfied with these admissions of guilt, and gave a chance for Parker to speak on behalf of the people. “As you heard, Ms. Vierkant and Mr. Deabay were running a (meth) cooking operation in the City of Norwich. She has no prior criminal history, so hopefully with treatment court she can be on the road to recovery.”
Kayphet Mavady, who represented the defendant, said, “Ms. Vierkant's children are the primary reason why she is straightening out her life.”
Before passing sentencing, Judge Revoir offered his thoughts, “I know that this is an extremely emotional case for you, and I'm glad that it is,” he said. “I have many people stand before me for sentencing and they don't bat an eye.” He continued to explain the dangers of meth operations, and the extreme dangers which they pose to the surrounding community.
Revoir sentenced Vierkant to six months incarceration at the Chenango County Correctional Facility, with five years post release probation. He also stipulated that Vierkant complete the drug treatment court program upon her release.
A written waiver of appeal was signed by Vierkant at the conclusion of matters.
