Sexual abuser sentenced to six months
NORWICH – The case of Donald J. Mercer was heard when the Chenango County Court met for an afternoon session on Monday, July 18. Chenango County District Attorney Joseph McBride appeared in representation of the people of Chenango County, while Mercer was represented by defense attorney James Chamberlain. The Honorable Judge Frank B. Revoir Jr. presided over matters.
Mercer, 50, of Smyrna, originally faced charges of rape in the third degree, a class E felony; three counts of criminal sexual act in the third degree, a class E felony; and endangering the welfare of a child, a class A misdemeanor.
It was alleged that Mercer, being over the age of 21 years old, did engage in sexual intercourse in November, 2013; oral sex in September, 2013; anal sex in December, 2013; and oral sex in January, 2014; as well as September 2013, with a 17-year-old female victim.
The endangering the welfare of a child charge alleged that Mercer knowingly acted in a manor likely to cause injury physically, mentally, or morally to the welfare of the victim.
In a plea deal with the DA's Office, Mercer agreed to enter a plea of guilty to a charge of statutory rape. He will receive a definite sentence of six months incarceration in the Chenango County Correctional Facility. An order of protection will also be issued for the victim for the maximum time allowed (10 years). Mercer will also have to comply with the sex offender registry and will be waiving his right to appeal.
Mercer's sentencing date was adjourned until September 9 at 9:30 a.m. While awaiting sentencing, Judge Revoir conveyed that Mercer must have no violations of the law and have absolutely no contact with the victim.
