Sherburne man sentenced to state prison for unlawful surveillance

NORWICH – A Sherburne man was sentenced to an indeterminate sentence of one and a third to three years in the New York State Department of Corrections when the Chenango County Court convened for a morning session last Friday, Sept. 23.
Dustin C. Freeman, who now resides in Quincy, Massachusetts, previously appeared in court on Aug. 8, and entered pleas of guilty to one count of unlawful surveillance in the second degree, a class E felony; and one count of dissemination of an unlawful surveillance image in the second degree, a class A misdemeanor.
According to his Mar. 2016, indictment, it was alleged that Freeman used a cell phone to video record a female victim while she was undressed in her own bedroom at an apartment complex on Classic Street, in the Village of Sherburne, on a day in the Fall of 2014 for his own amusement or entertainment and degradation of the victim.
Furthermore, the dissemination of an unlawful surveillance image charge alleges that Freeman did disseminate a video of the victim while in an undressed state to another individual at a local bar, in the Village of Sherburne.
First Assistant District Attorney Michael D. Ferrarese, who prosecuted the case on behalf of Chenango County, was the first to speak at Freeman's sentencing. “Judge, standing before you today is a defendant who has now been convicted of a felony for the second time and is being sent to state prison,” he began. He then addressed Freeman directly, saying, “You need to understand that you have to take responsibility for your actions and have to be punished. Understand that if you are caught again, sentences can carry up to life at the end. I hope that deters you from any further criminal activity.”
Annaleigh Porter, who represented Freeman, said, “He (Freeman) has come a long way. He is working full-time, and has reunited with his family. He's confident that he can still be employed full-time after his release from prison.”
Judge Revoir had no comment on the matter before he sentenced Freeman to serve an indeterminate sentence of one and a third to three years in the NYS department of corrections. He also specified that Freeman will not be subject to the sex offender registry.
Freeman executed a written waiver of appeal at the conclusion of proceedings.
