Guilford man sentenced on two counts of felony drug charges

NORWICH – A Guilford man was sentenced on drug charges following his arrest in Gilford in 2016.
Chenango County Court convened before Judge Frank B. Revoir Jr. on Monday to hear the matter of Samuel Rivera.
Rivera was present with his attorney John Cameron for this matter. District Attorney Joseph A. McBride was present on behalf of the people of Chenango County.
Rivera was originally arrested in April of 2016, while The Chenango County Sheriff's Office, in conjunction with the Village of Sidney Police Department conducted a 'no knock' search warrant at 104 Spreutels Lane in the Town of Guilford.
Revoir explained the two counts upon which Rivera would be sentenced. “The first count charges you, Mr. Rivera, with criminal possession of a controlled substance in the third degree, a class B felony and the second count of criminal possession of a controlled substance in the third degree, a class B felony ,” said Revoir. “It alleges that on April 20, at approximately 2 p.m. at 104 Spreutels Lane in the Town of Guilford that you did knowingly and unlawfully possess 280 bags of heroin, a large plastic bag of a chunky substance that tested positive for cocaine and 20 individually wrapped packets of cocaine.”
Rivera did enter a guilty plea at this time in court.
Revoir also put on the record, that during the original arrest contraband such as, four cell phones, a large amount of cash consisting of $720, digital scales and packaging materials would be forfeited to the local authorities.
“On April 20, sir were you in possession and with intent to sell cocaine and heroin?” asked McBride.
“Yes” answered Rivera.
“Judge, the only thing further I would like to say before the court and Mr. Rivera is that "’you need to stop getting with the criminal justice system, clean up, and become a healthier man. Good luck sir,’” said McBride.
Rivera was sentenced to determinate sentence of four years in state prison with two years post-release supervision at this time. The sentence will run concurrent with the previous sentence, as noted.
All fines, fees, and surcharges were waived at this time due to indigency. A written waiver of appeal was signed at the closing of the case.
