Accused burglar tells Judge he suffers from PTSD after being shot by victim

NORWICH – A defendant who was shot in the leg while committing an alleged burglary refused a plea deal in Chenango County Court Monday, saying he suffered post traumatic stress from the incident, as the case now moves closer to trial.

Refusing an offer by Assistant District Attorney Michael Ferrarese, Kevin M. Roof, refused to plead guilty to burglary in the second degree, with a plea-offer that would have him serving 10 years in state prison with 5 years post-release supervision. Ferrarese said the case was now moving forward and Roof could face up to 15 years in prison if convicted.

Roof, 44, of Binghamton was arrested on February 3, after a 911 call reported sounds of a gunshot in the Town of Afton, which would become a burglary investigation. The New York State Police arrested Roof a couple days later after he got out of the hospital on the morning of January 30, at around 11:10 a.m..

Police stated Roof was being treated for a non-life threatening gunshot wound to his upper leg, after he was shot by a the victim during the alleged burglary.

The District Attorney's Office reported that Roof's co-defendant, James Fletcher, pleaded guilty to attempted second-degree burglary, July 28, after he tried to break into the Town of Afton home with Roof.

During the proceedings on Tuesday, Roof was asked by Judge Frank Revoir if he felt the injury had a negative effect on his mental, emotional, and physical well-being. Roof stated it sometimes did impair his judgement and he cannot concentrate on anything. Roof went on to say the event "replays again and again" in his mind and he believes he has Post Traumatic Stress Disorder.

Judge Revoir asked Roof if he would say that some days are better than others in terms of physical pain, with Roof answering "yes, absolutely I would say that." The Judge went on to determine that Roof understood the legal action taking place that day, and it was found he was competent.

Roof was remanded back to the county jail and will appear back in court at a later date.
