Burglar shot by Afton homeowner faces 15 years in prison

NORWICH – A burglar who claimed he suffered from post traumatic stress disorder after being shot during a break-in last year pleaded guilty in county court on Friday.

Kevin Roof, 45, of Binghamton, admitted to the court to breaking into a home in the Town of Coventry on January 27, 2017, and three days later broke into another home in Afton, where Assistant District Attorney Michael D. Ferrarese explained he was shot by the homeowner and arrested.

Roof said, a co-conspirator in the case, James E. Flecher, who already pleaded guilty to burglary, knew there was money in the house.

When making his plea in court, Roof at first said he was just the driver but after prosecutors objected Roof admitted to a more active role in the crimes.

"I was just the driver of the car," said Roof at first, "James Flecher went in, took the money from the safe, and then we drove away."

However, A.D.A Ferrarese objected and said Roof was required to admit further guilt before he would accept the plea.

"Roof's DNA was found on a pair of gloves in the home, next to the safe. He went inside that home, " Ferrarese noted to the court.

After a discussion with his lawyer, Roof added to the admission, saying, "We went inside, I ripped the door right off of the safe, we took the money, and we left."

Roof told the court how he got into the Afton home, saying, "[We] opened the unlocked garage, walked in, and entered the house through the interior door."

After being asked what his intentions were when entering, Roof responded, "I absolutely intended to steal from the house."

During the course of one of the burglaries Roof was shot in the leg by a homeowner and brought to the Wilson Medical Center by police to receive treatment for a bullet wound, said Ferrarese.

Ferrarese also explained all the stolen jewelry was recovered by police, but about $210 taken from a safe was not recovered.

According to the plea deal made Friday Roof is facing a sentenced of 15-and-a-half years in state prison for the two crimes.

Sentencing is scheduled for March 23.
