Bainbridge audited on claims of conflict of interest

BAINBRIDGE – The village of Bainbridge has undergone the microscope of the New York State Comptroller for a conflict of interest among one of its now former trustees.

The Office of the New York State Comptroller reported in June that the Village of Bainbridge was audited on claims that one of its three trustees, the owner of a hardware store in the village, had dealings with the village government that provided him monetary benefit of $4,190 from 19 different supply contracts.

Doing so violated New York's general municipal law. And though the report “did not reveal any irregularities in pricing,” appropriateness is called into question, says the Comptroller's Office.

In response, Bainbridge Mayor Philip Wade said his village doesn't dispute the Comptroller's findings. The audit was done “in a fair and professional manner,” he said.

Nonetheless, Wade argues that the state ought to make accommodations for small municipalities which rely on dealings with small businesses, and that the current law “discriminates unfairly against small businesses upon which our economy is based.”

“The dollar limits have not been indexed for inflation, nor are there exemptions appropriate to villages of our size,” said Wade. “We sincerely hope that this incident will incentivize our legislators to update this law to make it more workable and appropriate in the future for small municipalities such as ours.”

Since the audit, the trustee has forfeited his position on good terms with the village board.

“Regrettably, he chose to resign his elected position rather than to further jeopardize village operations,” the mayor said. “We thank him for his service and will continue to patronize his business, and encourage others to do the same.”

The Comptroller has recommended that the village become familiar with article 18 of the general municipal law (barring such conflicts) and adopt procedures to help detect and prevent similar conflicts of interest in the future.
