Ramsaran murder case gets hearing after claims of inadequate defense at trial

NORWICH – On Monday lawyers for convicted murderer Ganesh R. Ramsaran will discuss how a future court hearing seeking a possible retrial will take place.

Appellate lawyers recently convinced Chenango County Frank Revoir Jr. to hear them out after they claimed Ramsaran never received a fair defense.

Ramsaran's current attorneys say he never received a fair trail because his lawyer at the time, Gil Garcia, was not qualified or experienced.

“To take $100k from this family and do nothing while he is being crucified – it's about the justice system, not guilt or innocence. Guilt or innocence comes later, we are talking about a bad process first,” Appellate Lawyer Melissa K. Swartz told the court in September while making the request for a hearing.

When she first heard about the murder case she said her response was “There is no way a bankruptcy attorney from New Jersey, who never tried a misdemeanor should be coming here to try the gravest of offenses possible. I thought it was a prank, it is absurd.”

Last week the judge agreed to grant a hearing request to discuss the work of defense counsel during the 2014 murder trial. Ramsaran was convicted of murdering his wife and was sentenced to 25 years to life after a jury convicted him on Sept. 23, 2014.

A closed-door conference is scheduled for Monday, where prosecutors, the judge and defense attorneys will determine how to move forward with a hearing.
