Mount Upton man accepts plea deal for felony drug charge
MOUNT UPTON – A Mount Upton man pled guilty in Chenango County Court this week for a felony drug charge.
Nicholas A. Marte, 44, of Mount Upton pled guilty to the third degree criminal possession of a controlled substance, the top count, and agreed to two years incarceration and two years post-release supervision.
Marte was indicted in 2022 by a grand jury on third degree criminal possession of a controlled substance, a class B felony, second degree criminal use of drug paraphernalia, a class A misdemeanor, second degree criminal impersonation, a class A misdemeanor and third degree aggravated unlicensed operation of a motor vehicle, a misdemeanor.
The indictment alleged on the evening of August 2, 2022, Nicholas A. Marte, 44, of Mount Upton, drove a 2006 Mitsubishi Lancer without a license. He allegedly told a City of Norwich Police officer his name was Victor Marte and also provided a false birthdate.
The indictment alleged that on the afternoon of August 8, 2022, Marte was discovered in his car with 87 glassine envelopes containing fentanyl with the intent to sell the packaged opioids. He also was allegedly in possessed paraphernalia to divide and package up the drugs.
