NY Police charged man for allegedly firing gun in Village of New Berlin meant to intimidate
NEW BERLIN - A New Berlin man is facing multiple felony charges after allegedly discharging a firearm to intimidate someone within village limits, according to the New York State Police.
At about 7:30 p.m. on Sunday, March 30, New York State Troopers from Norwich responded to a report of shots fired in the Village of New Berlin.
An investigation determined that Joseph R. Avery, 39, of New Berlin, allegedly fired a gun unsafely with the intent of intimidating another individual.
State police said Avery was located at his residence and arrested without incident. He was charged with second degree criminal possession of weapon, a class C felony; first degree reckless endangerment, a class D felony; second degree, a class E felony; and prohibited use of a weapon, a misdemeanor.
He was processed at the NY State Police barracks in Norwich and transported to the Chenango County Correctional Facility for arraignment in central court.
The New Berlin Police Department confirmed that the incident occurred in the village and stated the event was isolated. The New Berlin PD is assisting the state police and said there is no ongoing threat to the public.
“The New York State Police from Norwich responded promptly to the situation. Following a preliminary investigation, they identified a suspect and subsequently arrested an individual,” reported the New Berlin PD.
All charges are allegations, and defendants are presumed innocent until proven guilty in a court of law.
