County court deals with DWI cases; one goes to trial
NORWICH – Chenango County Court had set before it three separate cases of driving while intoxicated Monday, including one that went to trial. One case involved a repeat offender, one caused a four-car accident and one will see a defendant making her argument in front of a jury.
The first defendant, Timothy Fiske, Chenango Forks, pleaded guilty to driving while intoxicated. Judge W. Howard Sullivan asked if Fiske would like to say anything. A somber Fiske stood to address the court. “I take full responsibility for my actions. I am sorry, your honor,” Fiske said. The judge gave Fiske one to three years in a correctional facility with possible parole and issued fines in the amount of approximately $1,800. Fiske was cuffed less than two steps from the defendant’s chair and led out of the courtroom by a corrections officer.
The next case involved James R. Orr, whose actions caused a four-car accident on Nov. 18, 2005. While driving intoxicated at night, Orr neglected to put on his headlights and caused a four car accident. He was charged with a DWI and 1st degree reckless endangerment, because he “created a grave risk of death,” said Sullivan. Orr pleaded guilty and was ordered to pay restitution of about $3,800, plus court fees. His actual sentencing will take place Sept. 18 in Chenango County Court. A victim of the collision was in court yesterday and is expected to speak at his sentencing.
