Wlasiuk gets a new lawyer

NORWICH – Peter M. Wlasiuk has been assigned a new attorney to defend him against the murder charges standing against him. Local attorney Scott Clippinger was appointed to represent Wlasiuk by presiding Broome County Court Judge Martin E. Smith.
Clippinger said his client is an innocent man and has suffered at the hands of the legal system. “Here is a man that has had four years of his life taken away,” said Clippinger.
Clippinger said he had not reviewed the case enough to rule out the possibility of requesting a change in venue, saying, “ Judging from what I’ve read and watched in the media, it may be difficult to find a jury.” A change in venue would mean that the case could be tried outside of Chenango County for the purpose of finding a fair and impartial jury. Clippinger also said, “He (Wlasuik) is a destitute man because of the cost of his first trial.”
Wlasuik was found guilty of 2nd degree murder and given the maximum sentence of 25 years to life for allegedly murdering his wife Patricia and then staging a vehicle accident at Guilford Lake to cover it up in 2002. The New York Supreme Court of Appeals declared Wlasiuk’s first trial unfair and overturned the conviction in August, citing a number of procedural shortcomings most of them revolving around the introduction of past violent acts against his wife. The court said that certain letters and diary entries should not have been allowed by the judge and said “we find merit to defendant’s challenge to certain conduct of the prosecution.”
A new judge was been appointed to preside over the murder retrial. Administrative Judge Judith O’Shea of the 6th Judicial District appointed Smith to take the place of Chenango County Judge Howard Sullivan. Sullivan recused himself from the case saying, he did not want anyone second-guessing the result of the second trial and believed his presence may raise a question of doubt no matter what the outcome, even if none existed.
Wlasiuk is scheduled to appear in county court later today at 2:30 p.m. for his arraignment at the county courthouse.
