Man accused of sex with minor pleads guilty
NORWICH – A man accused of having a sexual affair with an underage student while working as a Sherburne-Earlville High School janitor pleaded guilty in County Court.
Shawn M. Clark, 28, County Rd. 24, Sherburne, pleaded guilty to 3rd degree rape, also known as statutory rape. Originally he was charged with third degree rape, third degree criminal sexual acts and endangering the welfare of a child. Clark never had any prior legal trouble with law enforcement and had maintained a relationship with the 16-year-old, who is now 17.
The couple allegedly had consensual sex and had family approval said Clark’s Public Defender Alan Gordon.
The allegations apparently came to light after the relationship ended on bad terms and the girl came forward said investigators.
“I do not believe Mr. Clark is a bad man and does not fit the typical sex offender stereotype. He got himself caught up in a situation of personal temptation and obviously made some bad decisions, and he is aware of that,” said Gordon.
The court scheduled for Clark to begin serving his term at the end of May and sentencing was postponed. Gordon asked for some time to review the details of his guilty plea with his client and then made a motion to delay serving his time so Clark could save up some money before going into the County Jail. Clark is expected to serve six months as was indicated by his plea bargain agreement and will become a registered sex offender, provided he does not commit any crimes before his actual sentencing in two weeks.
