Suspected getaway driver in Sherburne drug shoot-out arrested Thursday
SHERBURNE – Police have announced an end to their homicide investigation involving a drug robbery after arresting the last of the co-conspirators Thursday afternoon.
James F. Bush, 46, 291 Burdick-Medbury Rd., Norwich, has been arrested and is charged with first degree burglary, attempted robbery and third degree criminal possession of a weapon, all felonies.
“The investigation is concluded into the shooting death of (Joshua D.) Richheimer. Law enforcement officers from all the agencies did a great job in putting this case together. All the participants have been arrested and are in jail,” said Chenango County Sheriff Thomas Loughren.
Robert R. Reynolds, 46, and Nicholas S. Simonds, 21 of Pleasant Valley Road, Sherburne have both been charged with tampering with evidence for attempting to hide the body. Reynolds will be facing additional drug and weapon charges said police.
Police believe Bush’s role in the crime was to drive Richheimer to Reynolds house. Bush provided Richheimer with the sawed-off shot gun used in the attempted robbery. Although the gun was eventually buried with Richheimer’s body by the defendants, police discovered other parts of the firearm at Bush’s home yesterday after carrying out a search warrant, said investigators.
Also discovered at the Bush residence was the black leather motorcycle jacket Richheimer was last seen wearing, said Loughren.
On July 24, Richheimer, riding on Bush’s motorcycle, arrived at the home of Reynolds. Armed with Bush’s sawed-off shot gun he kicked down the door of the residence wearing nylon gloves and had duct tape on his person. Reynolds, the resident of the home, said this all happened at about 9:45 p.m., just after he had sold a large quantity of marijuana to another man who had already left.
Reynolds said he armed himself with his own 12-gauge shotgun that was kept loaded next to his bed and engaged Richheimer. Reynolds said he was shot at first and he then returned fire. During the course of this gunfight, Richheimer was shot in the abdomen and died.
Simonds was not in the home at the time of the incident but was a close neighbor and friend of Reynolds and helped to bury the body.
Police found the Richheimer’s remains with the sawed-off shotgun a few hundred yards from the home.
“This was a well organized investigation between us, the New York State Troopers, the Otsego County Sheriff’s Office and the New York State Forest Rangers. The combined efforts of all the agencies really brought this case a fast and sound conclusion and I commend the cooperation of all the departments,” said Lt. James E. Lloyd of the Chenango County Sheriff’s Office.
Public Defender Alan Gordon has been appointed to represent Reynolds.
Bush was arraigned before Town of Sherburne Justice Frank Faulkner and remanded to the Chenango County Correctional Facility without bail. Simonds was remanded to the Correctional Facility in lieu of $10,000 bail. Reynolds is being held on $100,000 bail.
