Bail reduced for accused Sherburne shooter

NORWICH – A man under the spotlight in a local homicide investigation appeared in county court for the first time Monday.
Robert R. Reynolds, 46, 476 Pleasant Valley Road, Sherburne, appeared in court with his lawyer, Scott Clippinger of Smyrna, to ask for a bail reduction.
Chenango County Judge W. Howard Sullivan lowered the bail from $1 million to $50,000.
“At the time the original bail amount was set, the defendant and others were part of a homicide investigation. At this time however, those charges have taken a back burner as more facts have been exposed in the case and now the people will be moving forward with the drug and evidence tampering charges,” said District Attorney Joseph McBride.
McBride called Reynolds a “serious marijuana dealer” who had between $3,000 to $4,000 cash at his home when he was arrested along with up to four pounds of marijuana.
“To be honest judge, because the defendant has chosen a life of crime and drug dealing, a life basically done behind closed doors, I have no way of knowing what other resources the defendant might have hidden away or how much he might be able to afford,” said McBride.
Reynolds was arrested in 1990 and served a sentence of 3 to 9 years in state prison for drug charges stemming from the possession of 10 pounds of marijuana. The prosecution also said it expected to lobby at least one additional charge of third degree criminal possession of marijuana (D felony) before the grand jury later this month.
Reynolds told police he acted in self-defense July 24, when Joshua Richheimer, 32, Pittsfield, allegedly broke into his residence armed with a sawed-off shotgun. Reynolds armed himself with a 12-gauge shotgun he kept loaded next to his bed, and the two men engaged each other inside the house. Reynolds said he was shot at first and that he returned fire. Richheimer was hit in the stomach and an autopsy later confirmed the injury as the cause of death.
“He (Richheimer) came into the house armed and hooded with articles for the purpose of either torturing or restraining my client,” said Clippinger.
Nicholas Simonds, Reynolds’ 21 year-old neighbor, allegedly helped move and bury the body in the nearby woods. Simonds is charged with evidence tampering and is in jail on $10,000 bail.
