No deal: Brown will takes his chances with a jury

NORWICH – An accused murderer facing life in prison without a possibility of parole rejected a plea bargain offered Wednesday, opting to take his chances with a jury.
Daniel L. Brown Sr., 46, faces counts of first degree murder, rape and assault in the slaying of Tammy L. Periard. The top three counts of his indictment each carry the possibility of 25 years to life in prison. If convicted of only the top count, Brown could face the rest of his life in prison without any chance of parole.
The Chenango County District Attorney’s Office offered a plea bargain that would fully satisfy the first degree murder charges. The agreement would have allowed Brown to plead guilty to second degree murder in exchange for a sentence of 25 years to life, which would hold the possibility of parole. Brown rejected the offer.
County Court Judge Martin E. Smith of Broome denied a motion made by Brown’s public defender, John D. Cameron, to have the grand jury indictments dismissed. A grand jury indicted Brown on two counts of first degree murder, one count of second degree murder, one count of first degree rape, two counts of first degree robbery and one count of first degree assault on April 23.
The defense also revealed its intention to offer psychiatric evidence in Brown’s defense. Smith said the defense had the right to have their expert interview Brown and then the prosecution could have theirs.
Several members of the Periard family attended the 20-minute court proceeding yesterday.
Brown’s next appearance is scheduled for 1 p.m. Nov. 5. The court said it would hear arguments over consent issues at that time concerning the search of Brown’s Henry Street apartment. Brown allegedly gave his consent to search his residence following his arrest. District Attorney Joseph McBride said the prosecution had a signed affidavit from the defendant agreeing to a search of his property. The body of the victim, along with the murder weapon and a large amount of other forensic evidence, was discovered at the scene.
Brown was arrested in March by the Norwich Police department following a three day search for a missing person.
Following a “strange phone call” to the Norwich PD from the Chenango Memorial Hospital, officers were dispatched to area in an effort to locate the suspect, said investigators. A short time later police discovered and identified Brown as the caller and arrested him. While in custody, Brown allegedly confessed to some aspects of the murder of his apartment manager to Norwich Police following his request for a lawyer.
Brown has been held at the Chenango County Correctional Facility without bail since his arrest in March.
