Grand jury indicts accomplice in fatal Sherburne drug robbery
NORWICH – A Chenango County grand jury has indicted James F. Bush, Burdick Medbury Road, Town of Norwich, on 12 felonies and two misdemeanors.
Bush allegedly aided co-conspirator Joshua D. Richheimer of Pittsfield in an attempted robbery of a local drug dealer, which ultimately led to a gun battle and Richheimer’s death on July 24.
Bush is accused of driving Richheimer to the home of Robert Reynolds, Pleasant Valley Road, Sherburne, on his motorcycle in order to rob Reynolds at gunpoint. Bush is also accused of providing Richheimer with the sawed-off shotgun used in the crime. A police investigation revealed that Reynolds killed Richheimer in self-defense.
Bush has a long criminal history, said police, and has been arrested more than 40 times.
Bush was indicted on two counts of first-degree burglary, two counts of first-degree criminal use of a firearm, three counts of first-degree robbery, two counts of second-degree criminal use of a firearm, second-degree criminal possession of a weapon, a felony, two counts of third-degree criminal possession of a weapon and two misdemeanor counts of fourth-degree criminal possession of a weapon.
Bush is currently in the Chenango County Correctional Facility in lieu of $100,000 bail. He is scheduled to appear in Chenango County court for an arraignment at 11 a.m., Sept. 24.
Reynolds pleaded guilty to second-degree unlawful possession of marijuana in exchange for his agreement to testify against Bush and faces one to two and a half years in state prison. Reynolds’ neighbor, Nicholas S. Simonds, 21, of Pleasant Valley Road, Sherburne, was charged with tampering with evidence for allegedly helping Reynolds hide Richheimer’s body after the incident. He was arraigned Monday on his Superior Court Information and pleaded innocent to the charge of tampering with physical evidence. Simonds was released on his own recognizance.
The grand jury also indicted:
• James C. Praitt, 27, Binghamton, was indicted for second degree rape and endangering the welfare of a child for allegedly having sex with a girl under the age of 15. Praitt allegedly drove his vehicle to a wooded area off Ives Hill road in the Town of Coventry and had mutual sexual relations with the underage girl.
• Tyrone T. Pose, was indicted on aggravated unlicensed operation of a motor vehicle and driving while intoxicated. Allegedly Pose was operating a 1996 Mercury on Maple Street in the City of Norwich while intoxicated.
• Mark L. Manwarren was indicted for driving while intoxicated in the Village of Sherburne. Manwarren was convicted of a prior DWI charge March 7, 2002.
• John R. Bourn was indicted for DWI for allegedly driving his vehicle along Cty Rt. 36 in the Town of Norwich while intoxicated. He has a prior conviction of DWI dated Jan. 18, 2007.
