Man charged in the shooting of five-year-old son
AFTON – Police have arrested a man they say is responsible for accidentally shooting his five-year-old son in the face at his home last week.
New York State Troopers have arrested Earnest J. Wurtz, 42, County Route 17, Afton, and charged him with first degree reckless endangerment (a Class D felony) and endangering the welfare of a child.
“Despite the obvious family turmoil of the father accidentally shooting his child, there is still some responsibility of pulling a trigger in an occupied home which could have easily caused the death of a child,” said District Attorney Joseph McBride.
Police responded to the shooting accident Oct. 1 at Wurtz’s home in Afton. While Wurtz was “checking the condition” of one of his firearms it discharged, according to police.
Police said only one round was fired. The bullet went through the bedroom wall and through an adjacent room before piercing the living room wall and hitting the boy in the face. The bullet traveled through two walls and struck him while he laid on the living room couch.
The boy was transported to Lourdes Hospital in Binghamton and treated for “non life-threatening injuries,” said police. Bullet fragments were surgically removed from his face.
The State Troopers, Chenango County Sheriff’s Office, Afton Police and the Chenango County District Attorney’s Office took part in the investigation and aided in the final decision to press charges.
Wurtz was issued an appearance ticket and released with the consent of the District Attorney’s Office. He is scheduled to appear in Town of Afton Court at a later date.
