Greene man faces five years probation following DWI charge

NORWICH – A Greene man changed his plea to guilty last week before Supreme Court Justice Kevin M. Dowd in a DWI case.
Donald L. Benedict Jr, Greene, will lose his license for one year, have to pay a $2,000 fine, a surcharge of $250, a supplemental fee of $25, waive his right to appeal, continue attending and complete drug treatment court and spend the next five years on probation for driving with a blood alcohol level of .14 percent. Anything more than .08 is over the legal limit.
“This is his last chance,” said District Attorney Joseph McBride. “If he doesn’t change, the next step will be state prison.”
In his own words, reflecting on the incident, Benedict said he was pulled over after having a “few” beers. When asked by McBride how many a few was, the answer the defendant gave was “five to six.”
The defendant had a previous DWI charge in Unadilla in 2000 that raised this charge to a felony. “You are getting to old for this,’ said Judge Dowd. “It is time to take responsibility.”
