Grand jury indicts four

NORWICH – The Chenango County grand jury handed up four indictments Wednesday; one included a Norwich man charged with several counts of child molestation.
Domineco R. Spinella, 26, 66 Borden Ave., was indicted on three charges that allegedly took place in March in the Town of Norwich: second degree criminal sexual act, a Class D felony, sexual misconduct and endangering the welfare of a child, both misdemeanors. Two other misdemeanor charges of forcible touching were alleged to have happened at the Oxford pool on July 7 and 31. Another charge, second degree criminal sexual act, a Class D felony, is said to have taken place July 3 in the Village of Oxford.
All of the charges concern the same 14-year-old female victim. Spinella remains in the Chenango County Correctional facility in lieu of $8,000 cash bail.
Frank J. Giacalone was indicted for first degree aggravated unlicensed operation of a motor vehicle, a Class E felony, and driving while ability impaired by drugs, a Class D felony. The incident allegedly took place at 4:29 a.m., June 5 in the City of Norwich along Hayes Street.
Giacalone has two prior convictions involving the use of drugs or alcohol while operating a vehicle. He was sentenced to a four-month term Aug. 29, 2003 and then again in Nov. 8, 2004, where he served one to three years indeterminate, and participated in the Shock Incarceration Program which is designed with boot camp like discipline.
Charles D. Aragona, 52, New Berlin, was indicted on charges of driving while ability impaired by drugs and driving while intoxicated, both Class E felonies, for allegedly failing sobriety tests at the scene. Police claim Aragona stated that he had ingested morphine, soma and hydrocodone pills at his time of arrest. The incident happen at 8:39 a.m., July 23 in the Town of Columbus along County Route 41. Aragona was convicted of driving while ability impaired by drugs on Oct. 25, 2001 in Monticello.
David I. Dunagan was indicted for second degree criminal possession of a forged instrument, a Class D felony. The incident, that allegedly took place June 12 in the Village of Sherburne, involved Dunagan having a forged check he attempted to cash in order to steal funds from another person.
All individuals charged by the grand jury yesterday will appear before Supreme Court Justice Kevin M. Dowd Aug. 27 at 2:45 p.m.
