Man arrested after gunshots in McDonough

McDONOUGH – The Chenango County Sheriff’s Office responded to a violent altercation between two men Monday morning after one fired a shotgun in the direction of the other.
At about 8:40 a.m. Monday, deputies went to the Town of McDonough after receiving a 911 call from William Carr, 47, of Town Line Road. Carr reported that he was involved in an argument with another man, James Fox, 43, of Loomis Road, McDonough, who had injured him.
“During the investigation it was discovered that Carr had fired a round from a shotgun during the dispute. Carr fired the round in the direction of another person, striking the ground in front of the person,” said Detective Sergeant Richard Cobb.
Although Carr called to report the incident, police investigators said “Fox had used justifiable force during the dispute with Carr.”
The two men got involved in an argument and police claim Carr armed himself with a hammer and threatened Fox. “It was determined that reasonable force was used after a threat was made, creating a real fear of being physically injured,” said Cobb.
Fox injured Carr after he threw an object at him, striking his hands. Carr later received stitches for severe finger lacerations at Chenango Memorial Hospital and was released.
Police said the two men’s stories vary greatly, but after the initial altercation Carr apparently armed himself with a shot gun and fired at Fox’s feet.
Carr was arrested on second degree criminal possession of a weapon, a class D felony, two counts of second degree menacing and one count unlawfully growing cannabis, both misdemeanors. 
Fox was arrested for unlawful growing of cannabis after he was allegedly found to be growing marijuana on his property.  Police said a third person was at the scene, but was not directly involved or injured.
Carr was arrested Monday and arraigned in the Town of McDonough Court. He was remanded to the Chenango County Correctional Facility in lieu of $10,000 cash bail.  Fox was arrested Tuesday and released. He will appear in Town of McDonough Court on Sept. 4.
The Sheriff’s Office was assisted at the scene by the New York State Police and the McDonough Fire Department Rescue Squad.
