Court releases man accused of having relationship with 14-year-old
NORWICH – A 26-year-old Norwich man accused of having an ongoing relationship with a 14-year-old girl was released from jail without bail following his appearance in Supreme Court last week.
Judge Kevin M. Dowd ordered the release of Domineco R. Spinella, 26, 66 Borden Ave., from the county jail after he had been placed on $5,000 cash bail by a lower court.
Public Defender Alan E. Gordon told the court Spinella was employed full-time and wished to continue working, had no prior criminal record except for a misdemeanor conviction in 2002, and would live with his parents.
“Your honor, Mr. Spinella has been sitting in jail for the past 27 days and on $5,000 bail. He doesn’t have anywhere near that amount,” said Gordon.
Gordon also said that the relationship between his client and the alleged victim was consensual. “There wasn’t any force involved and no violence indicated the allegations,” said Gordon.
Assistant District Attorney Stephen M. Dunshee said that Spinella’s prior conviction involved “similar predatory circumstances.”
Spinella pleaded guilty to endangering the welfare of a child in 2002 but Dunshee said there was more to it and at the time the defendant got cut a break because of his age and lack of criminal record.
The District Attorney’s Office objected to the bail request, asking that Spinella remain incarcerated saying he was a flight risk.
“This poor 14 year old girl was under the impression that this adult was her boyfriend. Any ongoing sexual relationship between 26-year-old and a minor should never be considered consensual. He manipulated and then took advantage of a young girl,” said Dunshee.
After granting his release, Dowd warned Spinella, saying, “Now don’t go and do something stupid that’ll screw this up for you, sir.”
Spinella was indicted on three charges that allegedly took place in March in the Town of Norwich: second degree criminal sexual act, a Class D felony, sexual misconduct and endangering the welfare of a child, both misdemeanors. Two other misdemeanor charges of forcible touching were alleged to have happened at the Oxford pool on July 7 and 31. Another charge, second degree criminal sexual act, a Class D felony, is said to have taken place July 3 in the Village of Oxford.
All of the charges concern the same 14-year-old girl.
