Jury pool exhausted, trial delayed in fatal drug robbery case
NORWICH – The trial of a Norwich man facing life in prison for his alleged role in a deadly drug shoot out was delayed Tuesday because attorneys unexpectedly exhausted the jury pool.
James F. Bush, 46, of Burdick Medbury Road in Town of Norwich, allegedly aided co-conspirator Joshua D. Richheimer of Pittsfield in an attempted robbery of a local drug dealer, which ultimately led to a gun battle and Richheimer’s death on July 24, 2007.
First Assistant District Attorney Stephen M. Dunshee said the “delay was unexpected, but not significant.” Earlier in the day, attorneys expected opening statements to begin by late afternoon.
The prosecution, along with assigned defense attorney Joseph J. Ermeti and his assistant attorney, Thomas Robert Cline of Binghamton, rifled through the 58 potential jurors and were only able to select 11.
Attorneys must wait to select the last juror and two alternates at 9:30 a.m., Monday when court is scheduled to resume, allowing time for additional jurors to be called.
Bush is accused of driving his co-conspirator to the home of Robert Reynolds, Pleasant Valley Road, Sherburne, on his motorcycle in order to rob Reynolds at gunpoint. Bush is also accused of providing the sawed-off shotgun used in the crime. A following Chenango County Sheriff investigation revealed that Reynolds killed the alleged co-conspirator, Richheimer, in self-defense.
Reynolds is expected to come face to face with Bush in court when he testifies against him as part of a plea agreement with the DA’s Office.
Reynolds pleaded guilty to second-degree unlawful possession of marijuana and will be sentenced one to two and a half years in state prison; the deal also requires him testify as a witness in the trial.
Bush turned down a five-year prison sentence in a plea bargain offered Oct. 6 and elected to risk 25 years to life in prison if convicted by a jury.
Bush remains at the Chenango County Correctional Facility in lieu $10,000 bail.
