Wlasiuk gets 25 to life; judge says he should never go free

NORWICH – Peter M. Wlasiuk has been sentenced to 25 years to life in state prison, with recommendation from the Broome County Court Judge Martin E. Smith that he never be released on parole.
In Chenango County Court Monday, Smith said it was his opinion that the evidence against Wlasiuk was overwhelming. “There’s no question in my mind you intentionally killed your wife and attempted to fake an accident,” said the judge.
Wlasiuk made a lengthy statement to the court where he professed his love for his late wife Patricia and their family. Wlasiuk was adamant that he should receive a new trial because he said the jury made its decision based on the existence of biased diary entries that he never had a chance to respond to in court.
After receiving affidavits from all 12 jurors and calling one to testify, Smith heard arguments from both attorneys on the allegations of jury misconduct. Smith ruled that there were no grounds to set aside the jury verdict based on the statements.
Wlasiuk said he would continue to fight the case with intent to appeal and maintains his innocence.
