Arrest made in random Oxford beating
OXFORD – Police have arrested an Oxford man for what appears to be a random attack on a local man walking his dog, striking him unconscious and fracturing his skull.
David Anderson, 32, of Oxford, was arrested Dec. 31 on a county court bench warrant. The warrant was for violating a conditional discharge placed on Anderson on March 27.
Sheriff’s investigators suspect Anderson was the perpetrator in the unprovoked attack on a 49-year-old Oxford man walking his dog in the village on Dec. 7.
Police said the victim was struck in the head at approximately 4:15 on the morning of Dec. 7 while walking his dog on North Washington Avenue.
The victim said the attack was entirely unprovoked and that he didn’t even exchange words with the assailant before he was suddenly struck unconscious.
When he came to, the victim said he was lying on the sidewalk, unsure of the extent of his injuries.
The 6’4”, 230 pound man was later taken to the emergency room at Chenango Memorial Hospital. He was treated for a fracture to his eye socket, a severe concussion and received several stitches before being released.
In 2005, Anderson pleaded guilty to seventh degree criminal possession of a control substance for possessing cocaine in a backpack. Originally charged with a felony, he was monitored by the Department of Probation and was eventually allowed to plea to a misdemeanor and sentenced to a conditional discharge.
“He was monitored by probation for nearly two years without a problem,” said Special Prosecutor James H. Fertig, who has taken over the case from the District Attorney’s Office, which has recused itself.
Anderson was ordered held on the warrant until his arraignment in Supreme Court yesterday. Judge Kevin M. Dowd remanded him to the Chenango County Correctional Facility without bail pending another appearance in the Village of Oxford Court, where he’s currently wanted on another warrant for the misdemeanor assault and criminal mischief charges.
Fertig said he wasn’t ruling out possible felony charges against Anderson and said he’d address the issue following his appearance in Oxford court.
