Brutal beating tops grand jury indictments

NORWICH – A grand jury has indicted a New Berlin man for allegedly attacking a teenage girl and holding her against her will.
Twenty-year-old Robert A. Mowers II was indicted for two counts of second degree assault, a Class D felony, for allegedly seizing the 19-year-old victim by her neck outside of his Drake Lane residence in New Berlin. The girl was choked to unconsciousness before Mowers dragged her into his residence, according to the indictment.
The victim later escaped Mowers and went to Chenango Memorial Hospital, where she was treated for multiple fractures to her jaw, chipped teeth and bruised legs, said New York State Police Investigator Michelle M. Marshall.
The victim was later transported to the Syracuse Medical Center. The brutal attack left the teen with multiple stitches and her mouth was wired shut, noted the indictment.
Police were contacted by medical officials and troopers soon located and arrested Mowers.
District Attorney Joseph A. McBride said Mowers was also indicted on a charge of first degree reckless endangerment, also a Class D felony, for “creating a grave risk of death” and a “depraved indifference to human life.”
In addition, Mowers was charged with first degree unlawful imprisonment, a Class E felony, for holding the victim against her will, the document said.
Police said the incident was “similar to a domestic dispute” in nature and that the victim and defendant knew each other.
Mowers was released on his own recognizance by Sixth Judicial District Court of Claims Judge Donald F. Cerio Jr. of Madison County, who was appointed to the case after Supreme Court Justice Kevin M. Dowd recused himself.
Mowers will appear in Chenango County Court April 20 and can face a maximum of seven years in prison if convicted of only one of the three felonies filed against him.
Also indicted by the grand jury Feb. 11 were a number of individuals charged with alcohol-related offenses.
• Eric A. Pike was indicted for first degree aggravated unlicensed operation of a motor vehicle and driving while intoxicated, both Class E felonies. Pike was arrested in the Town of Greene Feb. 1 and had his license already suspended for a prior DWI conviction from August 2006 in Tioga County.
• Marshal A. Waffle, 30, was indicted for first degree aggravated unlicensed operation of a motor vehicle and DWI. Waffle was arrested Jan. 4 in Sherburne. Waffle’s license had been suspended over two a prior alcohol convictions, DWI and driving while ability impaired, both in Madison County.
• Gary R. Palmer Jr., was indicted for DWI for allegedly operating a vehicle in the City of Norwich Jan. 17 while under the influence of alcohol. Palmer has a prior DWI conviction in from Jan. 2006 and a prior DWAI conviction from June 2000.
