Troopers charge Bainbridge man for giving alcohol to teens

NORWICH – Police have arrested a 21-year-old Bainbridge man for providing alcohol to the five teenagers involved in a fatal accident Saturday.
Thursday, New York State Troopers charged Joseph M. Beardsley with five counts of first degree unlawfully dealing with a child and one count of making a punishable false written statement.
Police said Beardsley purchased beer at a convenience store and then gave it to the five teens.
At 5:55 a.m. Saturday, April 18, 17-year-old Trebor E. Hoxie of Norwich, was allegedly driving a green 2001 Dodge Caravan along Route 206 with four passengers. Troopers said Hoxie lost control of the vehicle while negotiating a turn and hit a guide rail, which caused the van to violently roll over before coming to a rest on its wheels in the roadway. Troopers said none of the teens were wearing their seat belts and all of the occupants were ejected from the vehicle as it rolled down the highway. Police believe alcohol was a factor in the accident. Hoxie was charged with manslaughter.
Gilbertsville-Mt. Upton senior Ashley Crisell, 18, of Guilford, was killed in the crash after she suffered major head injuries. She was pronounced dead at Wilson Memorial Regional Hospital in Johnson City on Saturday.
The hospital reported Friday that two passengers, Darren Houck, 18, of Norwich and Kathryn Card, 17, of Morris, have been discharged.
They also reported that Kathryn McLaughlin, 17, of Mount Upton, remained at the hospital in “fair condition.” Her injuries include a skull fracture, broken pelvis, and foot amputation.
First Assistant Stephen M. Dunshee said Beardsley attended a drinking party with the teens in a wooded area in Morris. He said that just prior to the crash, Beardsley had been traveling in the minivan with the youths, but was dropped off at his residence in the Bainbridge area. Dunshee said the teens were most likely returning to Norwich when the accident occured.
“Following the motor vehicle accident, Joseph Beardsley then gave a false sworn statement to the New York State Police in which he denied buying or providing alcohol,” stated troopers in a release issued Thursday.
Beardsley was arraigned in the Town of Norwich Court and remanded to the Chenango County Correctional Facility in lieu of $5,000 cash bail.
All six of the charges facing Beardsley are class A misdemeanors, each carrying a maximum possible sentence of up to one year in local jail.
Hoxie was charged with second degree vehicular manslaughter following the accident and was remanded to the Chenango County Correctional Facility in lieu of $200,000 cash bail.
District Attorney Joseph A. McBride explained that although Hoxie is currently charged with a manslaughter as a D class felony carrying a sentence of up to seven years, the charge could be raised to a B class felony with a maximum 25-year sentence.
“If he’s convicted of the highest possible charge, there is a possibility he could do up to 25 years in state prison depending on the results of the blood-alcohol test and the results of the accident reconstruction,” said McBride.
According to McBride, if Hoxie’s blood alcohol content was above .18 percent, more than double the legal limit in New York State, and if police’s reconstruction of the accident showed he was driving in a “dangerously reckless manner,” consistent with a reckless endangerment charge, then he could potentially face the B felony.
New York State Police Lieutenant James E. Barnes said it would take about two weeks before police received the results of the blood test sent out Saturday.
Police said they are still continuing to investigate the incident.
