Greene man sentenced in child porn case

GREENE – A village man who pleaded guilty earlier this year to federal child pornography charges was sentenced to 12-and-a-half years in prison Thursday, Greene Police Chief Steven Dutcher confirmed.
Charles A. Robbins, 50, of 27 North Chenango St. in the Village of Greene, will be subject to lifetime post-release supervision upon completing his sentence.
Robbins was convicted in April of possessing and disseminating child pornography in Binghamton Federal Court, the same day as the mass shooting at the American Civic Association building nearby on Front Street.
“We’re satisfied with the outcome,” said Dutcher, adding that he thought the penalty was severe enough, considering Robbins had no criminal record prior to the offense. He was facing 15 to 16 years.
“We’re happy the case went federal,” Dutcher said. “There’s a much stiffer penalty for these crimes at the federal level compared to the state and local level.”
The Federal Bureau of Investigation and Greene Police stormed Robbins’ residence Dec. 12, 2008, acting on a no-knock search warrant after federal agents tracked child pornography to his computer from an Italian distributor.
The arrest was the result of an international probe by European police who were investigating customers of Sergio Marzola, who allegedly operated a Web site distributing pornographic images and videos of children.
Approximately 1,400 people in the U.S., including Robbins, bought material from Marzola, and either downloaded it from the Web site or had it sent by mail.
Court documents claimed DVDs discovered at Robbins residence contained sexual images of girls younger than 18.
Robbins was one of three Greene men charged with child pornography and sex-related crimes last year. His was the only case that went federal.
Last November, working with the New York State Police, the Greene police arrested James O’Brian, 43, of Greene, for nearly identical charges. He later pleaded guilty to possessing a sexual performance of a child less than 16 in Chenango County Supreme Court and was sentenced to six months in local jail and 10 years probation. He must also registered as a sex offender for no less than 20 years.
John M. Gavazzi, 46, of 21 South Chenango St., Greene. Gavazzi was arrested June 25 following a months-long investigation by the technical arm of the New York State Police into local child pornography Internet trafficking.
Also processed in county court, Gavazzi pleaded guilty to promoting child pornography, a Class D felony, and possession of child pornography, an E felony, on July 20. He admitted to having video and images showing a female under the age of 16 having sexual contact with an adult.
He has not yet been officially sentenced on the charges, but at his last court appearance.
Chenango County District Attorney Joseph McBride said the case was an agreed-upon disposition and that Gavazzi would be sentenced to six months in local jail, serve the next 10 years on probation and would have to register as a sex offender.
The Chenango County Correctional Facility reported that Gavazzi was released of the $50,000 cash bail originally imposed on him because of a court-ordered discharge. He is scheduled to be sentenced before Supreme Court Justice Kevin M. Dowd at a later date.
